No. PSC-27-23-00006-A Filing Date: 2026-09-18 Effective Date: 2026-09-18 PURSUANT TO THE PROVISIONS OF THE State Administrative Pro- cedureAct, NOTICE is hereby given of the following action: Action taken: On 9/17/26, the PSC adopted an order adopting, with modifications, the Joint Utilities (JU) proposal for a Greenhouse Gas (GHG) Emissions Inventory Report and directs the JU to file reports annually. Statutory authority: Public Service Law, sections 4, 5, 65 and 66 Subject: Greenhouse Gas Inventory Reporting. Purpose: To adopt, with modifications, the JU’s proposed GHG Emis- sions Inventory Report and directing annual filings. Substance of final rule: The Commission, on September 17, 2026, adopted an order adopting, with modifications, the Joint Utilities (JU) (the Joint Utilities include Central Hudson Gas & Electric Corporation; Consolidated Edison Company of NewYork, Inc.; NewYork State Electric & Gas Corporation; Niagara Mohawk Power Corporation d/b/a National Grid; Orange and Rockland Utilities, Inc.; Rochester Gas & Electric Corporation; The Brooklyn Union Gas Company d/b/a National Grid NY; KeySpan Gas East Corporation d/b/a National Grid; National Fuel Gas Distribution Corporation; Liberty Utilities Corp.; and Corning Natural Gas Corporation) proposal for a Greenhouse Gas (GHG) Emissions Inven- tory Report and directs the JU to file reports annually. The JU shall file an- nual Greenhouse Gas Emissions Inventory Reports, inclusive of Parts 1 and 2, providing emissions estimates, including natural gas distribution system emissions and emissions from end-user combustion. For 2027, the reports shall be filed by December 31, 2027, and for 2028, the reports shall be filed by September 1. Starting in 2029, the reports shall be filed by June 1 of each year with an accounting of such emissions for the past year. The first report in 2027 shall also provide estimates of historical annual emissions, in the same format, going back to 1990.The JU shall file, within 30 days of the issuance of the order, an updated comparison table, or Ap- pendix B: Methodology Comparison Table, as contained in the JUs’ Supplement to Proposal for an Annual Greenhouse Gas Emissions Inven- tory Report as filed on May 31, 2023. The JU shall file, within 60 days of the issuance of the order, a standard template for Parts 1 and Parts 2. The JU shall file, in each rate filing, incremental estimates of the natural gas distribution system emissions impacts of each project or program outlined in the proposed rate plan, on a per-project basis. The JU shall use New York State Department of Environmental Conservation emission factors 15 Rule MakingActivities as found in 6 NYCRR Part 253 where available and use reasonable alterna- tive emission factors for those not specified – first referring to available United States Environmental Protection Agency factors, then Natural Gas Sustainability Initiative factors if there is no established United States Environmental Protection A
