No. LPA-40-26-00003-P PURSUANT TO THE PROVISIONS OF THE State Administrative Pro- cedureAct, NOTICE is hereby given of the following proposed rule: Proposed Action: LIPA staff proposes to modify LIPA’s Tariff for Electric Service, effective January 1, 2027, to clarify the daily application of the Contract Demand Charges to Service Classification No. 11 (Buyback Ser- vice) and No. 12 (Standby Service). Statutory authority: PublicAuthorities Law, section 1020-f(u) and (z) Subject: Standby and Buyback Contract Demand Clarification. Purpose: To clarify the Tariff language regarding the application of these charges. Public hearing(s) will be held at: 10:00 a.m., Dec. 7, 2026 at H. Lee Den- nison Bldg., 100Veterans Memorial Hwy., Hauppauge, NY; and 6:00 p.m., Dec. 7, 2026 at Long Island Power Authority, 333 Earle Ovington Blvd., Uniondale, NY. Interpreter Service: Interpreter services will be made available to hearing impaired persons, at no charge, upon written request submitted within rea- sonable time prior to the scheduled public hearing. The written request must be addressed to the agency representative designated in the paragraph below. Accessibility: All public hearings have been scheduled at places reason- ably accessible to persons with a mobility impairment. Substance of proposed rule: The Long Island Power Authority (“LIPA”) staff (“Staff”) proposes to modify LIPA’s Tariff for Electric Service (the “Tariff”), effective January 1, 2027, to clarify the application of Contract Demand Charges to Service Classification No. 11 (“SC-11”) (Buyback Service) and Service Classification No. 12 (“SC-12”) (Standby and Op- tion Rate Service). The proposed modifications are intended to provide greater transparency regarding the application of Contract Demand charges and will conform the Tariff language to LIPA’s existing billing practices. These modifications will not change the methodology used to establish a customer’s Contract Demand or the manner in which custom- ers are currently billed. The LIPA Board may adopt, reject, or modify, in whole or in part, the action proposed, the commenters’ proposed programmatic changes, including recommendation(s) submitted by the New York State Depart- ment of Public Service, and may resolve related matters.
