The comment expressed concern that the lack of tenure for the incumbent of the Deputy Chief Procurement Officer (DCPO) could result in favoritism or political influence entering the procurement process.The comment also maintained that the position could be competitively tested through an examination of training and experience and that use of a non-competitive (phi tag) position foreclosed promotion opportunities for current Office of General Services (OGS) employees. The record in this matter establishes that the DCPO job title already ex- ists in the non-competitive (phi) jurisdictional class and the position func- tions as a primary advisor to the Chief Procurement Officer and serves as part of the OGS procurement executive team in a high-level managerial and policy making role. The need for a second DCPO position is justified by OGS’ expansive procurement portfolio and the increasing range and complexity of procurement activities. The Commission concurred with Department of Civil Service merit system experts that the position could most properly be assessed through an examination of candidates’qualifica- tions on a non-competitive basis, which requires over a decade of relevant procurement experience with partial substitutions for doctoral-level education. The Commission also notes that the non-competitive minimum qualifi- cations do not preclude experienced State competitive-class procurement managers from competing for appointment. Finally, the comment objected to the use of a single Consolidated Impact Analysis for all Commission State jurisdictional classification rule makings during a 12-month period. The Commission’s practice reflects a long-recognized finding that such Impact Analyses remain consistent for all similar jurisdictional rule making activities.
