Summary

The executive order postpones the expiration of certain rules pertaining to the Indiana Department of Child Services (DCS). The agency will have until January 1, 2028, to readopt expiring rules. The order specially addresses rules in the following sections: Extending the affected rules in the Indiana Administrative Code is expected to have no impact on DCS workload. These policies are included in (1) the most recent iteration of the DCS Child Welfare Policy Manual, (2) state statute, and (3) federal statute, to the extent that, if the pertinent Indiana Administrative Code rules were to expire, the processes for (a) transitional services for independent living of older foster youth and (b) the state adoption and guardianship assistance programs would not be disrupted. The DCS reports that extending the rules pertaining to transitional service plans for independent living and collaborative care would prevent the state from risking up to $11.45 M in annual federal funds from the Chafee and IV-E program for services and reimbursement of administrative costs.
