whether the rule implements a state statute for the first time: The Mechanical Licensing Board (Board) is seeking to readopt with amendment and repeal provisions in Chapter 700 relative to Voluntary Certification of Heating Installers and Heating Equipment Service Personnel. These rules establish the minimum training requirements for Voluntary Certification of Heating Installers and Heating Equipment Service Personnel. These rules implement RSA 153:16-b. The Board is seeking to streamline the rules and adopt changes made to the board upon the passage of RSA 310 and the Office of Professional Licensure and Certification (OPLC). The Board is proposing to adopt the Universal Application for Initial Licensure and the Universal Application for license renewal. The Board has realigned the rules with current statutory framework and repealed sections that are not supported by governing RSAs. Previously, the Board cited RSA 541:16, I(b), which does not contain legislative authority to establish administrative rules for these license types.
