Description of Subjects/Issues Pursuant to Rule 529.a, the Energy and Carbon Management Commission of the State of Colorado (ECMC or Commission), on its own motion, will consider additions and amendments to Commission Rules of Practice and Procedure, 2 C.C.R. 404-1 (Rules), 1200-Series as part of its Migration Pinch Point rulemaking. On April 16, 2019, Governor Polis signed Senate Bill 19-181 into law. As part of the rulemakings implementing Senate Bill 19-181's mandates, the ECMC adopted a definition of High Priority Habitat ("HPH") that defers to the expertise of Colorado Parks and Wildlife (CPW) to identify the species and habitats for which avoiding, minimizing, and mitigating impacts is critical based on the best available science. At the time, the ECMC noted that certain wildlife habitats were currently not mapped as part of HPH, and specifically identified pinch points or bottlenecks, and stopover areas within big game migration corridors. The ECMC initiates this rulemaking to add "migration pinch points" to Rule 1202.c.(1). The proposed Migration Pinch Point rule change is a result of research that supports the management of development in narrow migration corridors that CPW now internally maps as big game pinch points. However, the ECMC is not proposing the adoption of any HPH maps as a part of this Rulemaking. The ECMC intends to consider and adopt CPWs migration pinch point maps beginning in the 2027 HPH Maps Rulemaking, and in all subsequent annual HPH Maps Rulemakings.
