Description of Subjects/Issues By this Decision, the Colorado Public Utilities Commission (“Commission”) issues this Notice of Proposed Rulemaking (“NOPR”) to consider amendments and additions to the Rules Regulating Electric Utilities, 4 Code of Colorado Regulations (“CCR”) 723-3. Through this NOPR, the Commission seeks to codify minimum standards for utility wildfire risk assessment, mitigation planning, and proactive de-energization, including through public safety power shutoffs (“PSPS”). More specifically, and as explained below, the Commission proposes two sections of related rules: one for utility Wildfire Mitigation Plans (“WMPs”) and a second for PSPS events. Comments A virtual hearing on the proposed rules and related matters shall be held as follows: DATE: November 23, 2026 TIME: 9:00 a.m. PLACE: By video conference using Zoom at a link in the calendar of events posted on the Commission’s website available at: https://puc.colorado.gov/. Interested persons may file written comments in this matter. The Commission requests that initial pre-filed comments be submitted no later than November 2, 2026, and any pre filed comments responsive to the initial comments be submitted no later than November 16, 2026. The Commission will consider all submissions, whether written or oral.
