1. Comparison of the costs of the proposed rule(s) to the existing rule(s):
When compared to the existing rules, the proposed rules will decrease restricted state revenue and costs to certain state citizens by less than $1,000 per year.
2. Cite the Federal mandate. Identify the impact on state funds:
No federal mandate, no impact on state funds.
3. Cost and benefits of the proposed rule(s):
The proposed rules increase the minimum monthly net proceeds threshold used to calculate the Business Enterprise Program set-aside assessment from $1,700 to $2,800. This change would allow licensed managers to retain a greater share of their monthly net proceeds and would reduce set-aside assessment revenue received by the program (restricted account administered by the Department of Education). Based on FY 2026 program activity, the Department estimates the annual impact of this change will be less than $1,000 on the set-aside account, which is not expected to impact program operations.
A. To State general or State special funds:
See #3 above. No impact on state general funds.
B. To State citizens and political subdivisions:
See #3 above. No impact on political subdivisions.
C. To independently owned businesses:
None. 11. Statement Relative to Part I, Article 28-a of the N.H. Constitution: This proposal does not mandate any new, expanded, or modified programs or responsibilities to any political subdivision in such a way as to necessitate additional local expenditures by the political subdivisions, and therefore does not violate Part I, Article 28- a of the New Hampshire Constitution.
