I.D. No. PSC-38-26-00010-P PURSUANT TO THE PROVISIONS OF THE State Administrative Pro- cedureAct, NOTICE is hereby given of the following proposed rule: Proposed Action: The Commission is considering a petition for clarifica- tion regarding a Pole Attachment Rate and an SC-3 Facility Charge filed in response to the Commission’s Order Determining Revenue Require- ment and Rate Design, issuedAugust 14, 2026, in Case 25-E-0724. Statutory authority: Public Service Law, sections 5, 65 and 66 Subject: To consider tariff rates for a Pole Attachment Rate and SC-3 Fa- cility Charge. Purpose: To ensure pole attachment and facility charges are just and reasonable. Substance of proposed rule: The Commission is considering a petition filed by the Village of Freeport (Freeport) for clarification of the Commis- sion’s Order Determining Revenue Requirement and Rate Design (Rate Order), issuedAugust 14, 2026, in this proceeding. The Rate Order autho- rized Freeport to increase its annual electric revenues by approximately $5,912,248, or 15.8 percent in total revenues. The petition observes that the Rate Order did not address two of Freeport’s proposed tariff changes but directed Freeport to cancel the affected proposed tariff leaves, which Freeport did. The two proposed changes regard establishing pole attachment rates and an increase to a facilities charge for outdoor area lighting. The petition requests the Commission to clarify that the Rate Order did not decide to deny ei- ther proposal. Additionally, the petition requests the Commission authorize Freeport to amend its electric tariff schedule, P.S.C. No. 9 – Electric- NYS Register/September 23, 2026 ity, to establish Pole Attachment Rental Rates, as proposed on Leaf No. 56.3, and to increase the monthly Facilities Charge under Service Classification No. 3 – Outdoor Area Lighting, as proposed on Leaf No. 62. If authorized by the Commission, the proposed tariff amend- ments would add a rental rate per wire pole attachment of $16.75, which aligns with the rate the Commission adopted for other munici- pal utilities in its Order Establishing Updated Pole Attachment Rates, issued November 18, 2022, in Case 22-E-0435. Additionally, the monthly Service Classification No. 3 Facilities Charge would increase from $9.68 to $11.78, consistent with the per-lamp charges the Rate Order authorized under the same service classification. The full text of the proposal and the full record of the proceeding may be reviewed online at the Department of Public Service web page: www.dps.ny.gov. The Commission may adopt, reject, or modify, in whole or in part, the relief proposed and may also resolve related matters.
