Department of Wildlife and Fisheries Wildlife and Fisheries Commission Wildlife Rehabilitation Program (LAC 76:V.131) The Wildlife and Fisheries Commission does hereby give notice of its intent to amend LAC 76:V.131, the rule governing the department's Wildlife Rehabilitation Program, to conform that rule to R.S. 56:129, enacted by Act 725 of the 2026 Regular Session of the Louisiana Legislature. Act 725 permits wildlife rehabilitators licensed under the program to possess white-tailed deer, subject to conditions the legislature established governing which deer are eligible for rehabilitation, how they are housed and monitored for Chronic Wasting Disease, and where they may be released. Section 131 did not previously authorize possession of white-tailed deer under a rehabilitation permit, so the rule and the statute are currently in conflict. The proposed amendment resolves that conflict by incorporating the statutory conditions into the program rule, giving rehabilitators, the public, and department staff a single provision of the Louisiana Administrative Code to consult. Because the substance of the action is set by statute, the amendment neither adds to nor narrows what the legislature required. The intended action complies with the statutory law administered by the commission and is promulgated in accordance with the Louisiana Constitution, Article IX, Section 7, R.S. 56:3, R.S. 56:5, R.S. 56:6(10) and (15), R.S. 56:115, R.S. 56:126, and R.S. 56:129. The secretary of the Department of Wildlife and Fisheries is authorized to take any and all necessary steps on behalf of the commission to promulgate and effectuate this Notice of Intent, including but not limited to, the filing of the Fiscal and Economic Impact Statement, the filing of the Notice of Intent, and compiling public comments and submissions for the commission’s review and consideration. In the absence of any further action by the commission following an opportunity to consider all public comments regarding the proposed Rule, the secretary is authorized and directed to prepare and transmit a summary report to the legislative oversight committees and file the final Rule. 6.The WRP does not authorize the possession of bears, wild turkeys, outlaw quadrupeds, nutria or alligators unless specifically stated on the permit. a.Rehabilitation of white-tailed deer originating from outside of Louisiana shall be strictly prohibited. b.The rehabilitation of injured or orphaned white-tailed deer originating from within a Chronic Wasting Disease (CWD) Management Zone shall be permitted, however, any such deer shall be rehabilitated and released only within the boundaries of the same CWD Management Zone from which the animal originated. i.Any person or entity engaged in the rehabilitation of such deer shall be strictly responsible for the monitoring of the animal’s health during rehabilitation and shall maintain a diligent watch for any neurological symptoms or other indicators consistent with CWD. ii.Failure to comply with the provisions of this Subparagraph shall constitute a violation subject to penalties as provided by law, and may result in the revocation of any applicable rehabilitation permit. c.Any animal that displays abnormal neurological symptoms shall be euthanized and a CWD sample shall be submitted to the department. Until a negative CWD result is received, all deer within the facility shall remain quarantined. d.If any deer from a rehabilitation facility receives a positive CWD result, all live white-tailed deer shall be euthanized and CWD samples shall be collected. That rehabilitation facility shall be prohibited from participating in deer rehabilitation activities in the future. e.Any white-tailed deer that displays an open fracture, neurological symptoms, or symptoms of epizootic hemorrhagic disease or bluetongue virus shall be ineligible for rehabilitation. f.Any white-tailed deer that displays signs of being habituated to humans shall be ineligible for rehabilitation. g.The minimum enclosure size shall be fifteen feet by twenty feet by eight feet for a single fawn. The pen shall be increased by fifty square feet for each additional animal. The maximum number of fawns allowed per enclosure shall be four, regardless of size. The enclosure shall be constructed of wood or wire with a minimum thickness of twelve gauge with no greater than two-inch mesh or other sturdy materials to prevent escape and to prevent domestic animals or predators from gaining access to the pen. The enclosure shall be constructed in an area out of sight of high traffic human and pet activity. If wire mesh fencing is used, a privacy or shade cloth shall cover all sides. h.Once fawns are accustomed to drinking from a bottle, they shall be fed only from a hanging rack. i.The WRP holder shall notify the Department permits coordinator at least 72 hours in advance of a planned release. The predetermined release location shall be specified by the Department of Wildlife and Fisheries prior to each release. j.No tags, collars, or other visual marks on white-tailed deer to be released shall be allowed.
