Department of Health Radiologic Technology Board of Examiners Radiologic Technologists(LAC 46:LXVI.Chapters 1, 3, 7, 9, 11, 12, 13, and 15) Notice is hereby given that the Radiologic Technology Board of Examiners, pursuant to the authority of the Louisiana R.S. 37:3207 et seq., and in accordance with the provisions of the Louisiana Administrative Procedures Act, R.S. 49:950 et seq., intends to amend its rules governing the practice of Radiologic Technology to establish Radiologist Assistants as a distinct licensure category within the profession. The proposed amendments update and clarify existing regulatory language to reflect processes, procedures, professional standards, and administrative practices related to licensure, and scope of practice. Additionally, the board proposes amendments to its rules governing fees and expenses. These revisions are intended to update and clarify the board’s fee structure and administrative procedures associated with licensure and regulatory operations. The proposed Rule changes governing fees are promulgated pursuant to R.S. 37:3218, which authorizes the board to establish and collect reasonable fees for the issuance, renewal, reinstatement, or administration of licenses and permits and other administrative functions provided for under the Chapter. The amendments are intended to ensure the board’s rules remain consistent with statutory authority, operational needs, and professional and regulatory standards. Radiologic Technologists Chapter 1.Implementation of the Medical Radiation Health Safety Act §101.Authority A.The Louisiana Medical Radiation Health and Safety Act, R.S. 37:3200 through R.S. 37:3221, provides that, in order to safeguard life and health by preventing excessive and improper exposure to ionizing radiation, any person practicing or offering to practice as a radiologic technologist in this state shall submit evidence that (s)he is qualified to do so and shall be allowed to practice as a radiologic technologist. The Act creates a board of examiners with regulatory authority, dictates the board's composition and qualifications, methods of appointment of office of the board members. The duties of the board are specified in the act and these duties provide for the implementation of the Medical Radiation Health and Safety Act through the adoption of rules and regulations. However, the executive director and his/her designee or staff may informally investigate anonymous allegations or complaints received by the board. 2.If the information provided to the board by the complainant is insufficient, the board may request further information by either written correspondence or through an informal proceeding. The informal resolution of the allegation(s) may be accomplished through correspondence between the executive director or his/her designee and the licensee or permit holder; by conference of the executive director or his/her designee and the licensee or permit holder; or by consent order between the licensee or permit holder and the board. 2.The executive director or his/her designee shall be authorized by the board to propose a recommended consent order to the licensee or permit holder which would outline the details of disciplinary action between the parties as a consequence of the allegations. B.The proposed consent order offered by the board through its executive director or his/her designee shall not be deemed as absolute and final until such time as the board ratifies the provisions of the said order. C.A consent order between the board and the licensee or permit holder or prospective licensee or permit holder shall describe the disciplinary action which will be taken. The consent order shall be signed by the licensee or permit holder or prospective licensee or permit holder, and two board members. D.… E.If, at any point during investigation or during informal/formal proceedings as described herein, the board finds that public health, safety, or welfare imperatively requires emergency actions, the board is hereby authorized to immediately suspend the license or permit of the licensee or permit holder during the course of the proceedings. Licensees shall be restricted to the use of ionizing radiation by the category that is defined on his license. Permit holders shall be restricted to the purpose specified for the permit. B.No person holding a license or permit under these rules and regulations shall use radioactive substances or equipment emitting or detecting ionizing radiation on humans for diagnostic or therapeutic purposes unless under the direction and supervision of a licensed practitioner and unless so directed by prescription of a licensed practitioner. C.No person shall knowingly employ as a radiologic technologist any person required by the provisions of these rules and regulations to hold a license or permit who does not hold a license or permit under these rules and regulations. D.A radiologist assistant may perform advanced imaging procedures and patient management tasks delegated and performed under the direct supervision of a radiologist. B.The board establishes as the passing criterion on the ARRT, NMTCB, ASCP written examination the passing score as established by the credentialing agency. If a license or permit applicant must change the mailing address which was entered on the application form, the applicant must inform the board in writing. Changes in the licensee or permit holder name are to be handled in the same manner, but must be accompanied by documentary evidence of the change (e.g., copy of marriage certificate, legal name change form, etc.). 12.Biannual Application for Permit Renewal a.Notification for the renewal of the permit will be emailed to each limited x-ray machine operator whose permit to practice limited x-ray machine operation will expire that May 31 with the permit fee due. Renewal season is March 1 through May 31. b.Notification for renewal of permit shall be emailed prior to expiration by the board to each person holding a permit issued under these rules and regulations. Such notification shall be emailed to the most recent address as reflected in the official records of the board. c.The Limited x-ray machine operator is responsible for renewal in the event of not receiving emailed notification. The continuing education requirement is independent of the number of licenses held by an individual (i.e., a radiologic technologist certified in both radiography and radiation therapy technology needs only 24 credits). Failure to provide documentation acceptable to the Louisiana State Radiologic Technology Board of Examiners will result in an expired status. The Louisiana State Radiologic Technology Board of Examiners will accept copies of documents. Original documents shall be kept by the radiologic technologist for two years after the end of the licensing term for the purpose of further verification should the board choose to audit the licensees' submissions. Individuals who are listed as having an expired status, due to failure to meet these renewal requirements, status will be published on website by the Louisiana State Radiologic Technology Board of Examiners and will be reported in response to any inquiries regarding the radiologic technologist's status with the Louisiana State Radiologic Technology Board of Examiners. B.A radiologic technologist whose license has been placed on expired status for failure to meet continuing education requirements may be returned to an approved status by payment of the appropriate fees and expenses as specified in Section 1217 of this Chapter and performing one or more of the following: 1.passing an advanced level examination recognized by the LSRTBE; 2.passing an entry-level examination recognized by the LSRTBE in a different category; 3.completing the required continuing education hours in the six months (on or before December 31) following the May 31 expiration date and paying delinquency fee. C.Any hours completed or other requirements met while expired may not be used to meet the continuing education requirements for the subsequent license term. The number of hours may be modified by the board on a case-by-case review of supporting documentation, evidence and/or testimony; 2.the board must receive a timely request for an exemption. In particular, the proposed Rule has no known or foreseeable impact on: 1.the stability of the family; 2.the authority and rights of persons regarding the education and supervision of their children; 3.the functioning of the family; 4.family earnings and family budget; 5.the behavior and personal responsibility of children; 6.the ability of the family or a local government to perform the function as contained in the proposed Rule. Poverty Impact Statement It is anticipated that the proposed Rule should not have any known or foreseeable impact on any child, individual, or family as defined by R.S. 49:973.B. (R) Executive Director FISCAL AND ECONOMIC IMPACT STATEMENT FOR ADMINISTRATIVE RULES RULE TITLE: Radiologic Technologists I.ESTIMATED IMPLEMENTATION COSTS (SAVINGS) TO STATE OR LOCAL GOVERNMENT UNITS (Summary) The cost for the Louisiana State Radiologic Technology Board of Examiners (LSRTBE) is approximately $2,600 in FY 27 for the notice and rule publication in the Louisiana Register. LSRTBE operates onself-generated revenue primarily from licensing and renewal fees. Other than the cost of rulemaking, there are no estimated implementation costs or savings to state or governmental units resulting from the promulgation of the proposed rule changes. Pursuant to Act 929 of the 2026 RS, the proposed rule establishes a licensure category for Registered Radiologist Assistants (RRAs), adopts related practice provisions for these advanced-practice radiologic professionals, and clarifies temporary working permit and limited-purpose permit language throughout the rule. The proposed rule also modernizes and increases the LSRTBE’s fee schedule to better align fee collections with the cost of administering licensure, permitting, compliance monitoring, and regulation of the profession. II.ESTIMATED EFFECT ON REVENUE COLLECTIONS OF STATE OR LOCAL GOVERNMENTAL UNITS (Summary) The proposed rule is expected to generate approximately $183,000 in additional SGR in FY 27, $176,000 in FY 28, and $155,200 in FY 29. The exact amount will depend upon future licensure, renewal, permit, and verification activity. III.ESTIMATED COSTS AND/OR ECONOMIC BENEFITS TO DIRECTLY AFFECTED PERSONS, SMALL BUSINESSES, OR NONGOVERNMENTAL GROUPS (Summary) While license applicants, permit applicants, licensees, and permit holders will experience increased fees for applications, renewals, and related administrative services, the rule is expected to increase LSRTBE’s SGR beginning in FY 27. The additional revenue will help maintain effective regulatory oversight that protects public health and safety through licensure, compliance monitoring, and disciplinary review, while also supporting modernization of administrative processes and technology systems to improve the licensing and permit experience. The establishment of RRA licensure creates a formal regulatory pathway for nationally credentialed RRAs to practice in Louisiana. RRAs are advanced-practice radiologic professionals who work under radiologist supervision and may assist with patient management and certain imaging procedures as part of a radiologist-led healthcare team. Healthcare facilities, physician practices, hospitals, and imaging centers may benefit from improved workforce utilization and operational efficiency through the use of licensed RRAs. IV.ESTIMATED EFFECT ON COMPETITION AND EMPLOYMENT (Summary) The proposed rule change, including the addition of RRA licensure, is not expected to adversely affect competition within Louisiana’s healthcare market. Instead, recognition of RRAs as a licensed category may have a positive effect on employment opportunities and workforce mobility by establishing a recognized licensure pathway for individuals who hold national RRA credentials. The rule may encourage qualified practitioners to practice in Louisiana and provide career advancement opportunities for radiologic technologists pursuing advanced education and certification. The rule is not expected to displace radiologists or other licensed healthcare professionals. Rather, RRAs serve as physician extenders who operate under radiologist supervision within a radiologist-led care model. The principal effect of the rule is anticipated to be improved utilization of specialized healthcare personnel, greater operational efficiency in imaging services, and enhanced patient access to radiologic services where facilities use advanced imaging support personnel.
