The plan shall seek to utilize resources and information available through the Louisiana Commission on School and Nonprofit Security. The principal or school leader shall: 1.complete an annual school safety questionnaire; a.The questionnaire shall request information related to the school’s compliance with plan requirements, completion of required drills, and identified needs related to emergency response and preparedness. b.Upon completion of the school-level questionnaire by each school, the local governing authority shall complete a district-level questionnaire. c.Both the school-level and district-level questionnaires shall be submitted to the LDOE and the Louisiana Center for Safe Schools. 2.annually review the emergency operations plan, revising as necessary; a.When preparing or revising the plan, consult with the district safety and emergency team. The principal and the threat assessment team shall determine whether to consider input from students enrolled in the school and their parents, faculty and staff, and community leaders. The principal of a high school shall seek and consider input from the students enrolled in the school who shall be represented by either the president of the senior class or the president of the student council and at least one other responsible student selected by the principal. b.The district safety emergency team shall include, at a minimum, the local school superintendent, a representative from school facilities, transportation, school nutrition, curriculum, student services , athletics, logistics, mental health, medical services, technology, and special education. The team shall also include the emergency response coordinator, the public information officer, and an elementary, middle, and high school principal. The emergency response coordinator shall be selected by the superintendent to oversee the development of the emergency operations plan and any associated training. . c.The plan shall provide for an all-hazards approach for emergency events, including any event with a hostage, an active assailant , or a building lock-down. 3.within the first 30 instructional days of each school year, conduct a safety drill to rehearse the plan, including an active assailant scenario, and conduct at least one additional drill during high traffic or transition points in the school day; 4.not later than seven days after each drill, submit a written report summarizing the details of the drill to the local superintendent or emergency response coordinator, who shall provide feedback on the drill to the principal, and the principal shall consider the feedback when revising the plan; 5.be responsible for providing in-service training pertaining to the plan for all teachers and school employees each school year. Such training may be incorporated into a meeting or training session held for another purpose and shall involve local law enforcement, fire, public safety, and emergency preparedness officials in the preparation and presentation of the training. The training shall include an active assailant exercise and shall be reported to the local school superintendent and the LDOE; 6. - 7.… 8.The door of each classroom and other instructional space shall be locked and secured to prevent entry into the room when it is occupied by students, except between class periods when students are moving between classrooms and other activities. A door is considered locked and secured when no devices or obstacles are present which would prevent the door locking mechanism from being fully engaged as originally designed or intended. a.If a classroom or other instructional space is left unlocked or open for any other reason, the door shall be actively staffed by an authorized person standing or seated at the door. b.Classroom doors with locks shall be in compliance with legislatively enacted code requirements and all fire safety standards of the office of the state fire marshal. c.Each plan shall provide that a locked door shall not obstruct egress. 9.Emergency preparedness exercises shall be classified as either discussion-based exercises such as orientation, seminars, workshops, or tabletop exercises; or classified as operations-based exercises such as drills, functional exercises, and full-scale exercises. 10.The emergency operations plan shall account for the method by which law enforcement officers and other first responders can obtain access to locked facilities, including all external and internal locks, or the location of the exterior master key box.

K.Preventative Programs. Each LEA shall develop, as a component of the Emergency Operations Plan, one hour of training in each of the following areas. The school selecting and providing the initial training must provide the educator with a certificate containing the educator’s name, date of completion, length of training, and topic covered. The educator and school shall maintain documentation of the training, once completed, which is sufficient to satisfy this requirement upon transfer to another LEA. B.Deepfake Material Prohibition. The student code of conduct shall prohibit the use of deepfake material. 1.Deepfake Material—any audio or visual media in an electronic format, including any motion picture film or video recording, that is created, altered, or digitally manipulated in a manner that would falsely appear to a reasonable observer to be an authentic record of the actual speech or conduct of the individual or that replaces an individual’s likeness with another individual as depicted in the recording. 2.Deepfake does not include material that constitutes a work of political, public interest, or newsworthy value, including commentary, criticism, satire, or parody, or that includes content, context, or a clear disclosure visible throughout the duration of the recording that would cause a reasonable person to understand that the audio or visual media is not a record of a real event. 3.No student at an elementary or secondary school shall use material considered to be deepfake against a student enrolled in kindergarten through twelfth grade, with the intent to coerce, harass, intimidate, or maliciously disseminate or sell the material. I.Assault or Battery on a School Employee. As used in this Subsection, school employee includes any person employed by the school in a full-time, part-time, permanent, or substitute position, as well as bus operators and school volunteers. 1.A student formally accused of committing an assault or battery, R.S. 14:34.3 or R.S.14:38.2, on a school employee shall be immediately suspended and removed from the school premises. The student shall be prohibited from returning to the school premises without the benefit of out-of-school suspension procedures, and necessary notifications and procedures shall be implemented as soon as is practicable. 2.A student found guilty by a court of competent jurisdiction or found guilty at a school system suspension hearing of committing a battery or assault on a school employee, shall immediately be recommended for expulsion by the principal or designee in accordance with the provisions of this Section. Any such expulsion shall be for not less than two complete school semesters in an alternative school or alternative educational placement, and the student shall participate in an anger management program. 3.The student shall not be placed at or allowed to attend the same school at which the battered or assaulted school employee is assigned, except when the school system has no other school of suitable grade level for the student to attend. 4.The requirements of this Subsection are applicable when an incident occurs off school property as a continuation of a documented altercation that began at school. 5.All documentation related to the incident shall be included and maintained in the student’s records. C.Career-Related Activities. To prepare students for choosing a career option at the high school level, at least six activities which expose students to career and technical and academic fields of study shall be conducted at each grade level in grades six through eight during each school year. Such activities shall include career interest inventories in sixth grade, updated in seventh and eighth grade, and information to assist students in the career decision-making process. Career Practicum—a limited scope educational franchise operation conducted on a public high school campus pursuant to a cooperative endeavor agreement, whose primary purpose is to deliver compensated, credit-bearing work-based learning, aligned to BESE-approved career pathways, and related instruction. Fair Market Value—the value of public assets, services, or resources made available to a business partner, including space, utilities, equipment, or other measurable benefits, calculated using commercially reasonable valuation principles and BESE-approved methodology. Hazardous Occupation—any occupation or activity prohibited for minors under the provisions of the Louisiana Works rules governing the employment of minors. Instructional Scope—the defined operational boundaries of a career practicum that are directly tied to instructional objectives, including pathway aligned activities, financial literacy instruction, employability skill development, and compensated work-based learning. Student Participant—a student enrolled in a BESE-approved, work-based learning course who participates in a career practicum and is compensated as an employee of the business partner. B.A city, parish, or other local public school board may establish and host one or more career practicums on a public high school campus. C.A career practicum shall operate exclusively within the instructional scope defined in the cooperative endeavor agreement and shall not engage in general commercial activity unrelated to instructional purposes. 1.The cooperative endeavor agreement shall be between the city, parish, or other local school board and the business partner. 2.The agreement shall include but not be limited to the following: a.a declaration of the essential educational and public purpose served; b.enforceable, nongratuitous obligations of the business partner; c.an inventory and valuation of public assets utilized, including a fair market value schedule; d.annual fair market value recertification; e.a clear statement of instructional scope and operating parameters; f.liability insurance naming the city, parish, or other local school board and the state as additional insureds; g.indemnifications of the city, parish, or other local school board and the state; h.safety, supervision, and training requirements; and i.compliance with applicable federal and state laws governing student data privacy, child labor, workplace safety, and accessibility. 3.The cooperative endeavor agreement shall be public record and posted on the website of the city, parish, or other local school board. D.Career practicums shall align with BESE-approved career pathways and integrate financial literacy and employability skill development, and shall be structured so that student participants are the primary beneficiaries of the educational experience. E.A student participating in a career practicum who performs credit-bearing internship experience aligned to a BESE-approved career pathway shall satisfy the requirements for an internship for school and district accountability. F.A business partner shall provide reciprocity under the cooperative endeavor agreement that meets or exceeds the fair market value of public assets utilized and shall fulfill all educational obligations established in the agreement. G.Career practicums may provide customer facing services only to the extent such services fall within the instructional scope established in the cooperative endeavor agreement. H.Career practicums operating solely within the instructional scope of a compliant cooperative endeavor agreement shall be deemed instructional functions of the city, parish, or other local school board and shall not be classified as commercial tenants. I.Any employee, agent, or representative of a business partner who has direct and unsupervised interaction with students participating in a career practicum shall be subject to the same criminal background check and eligibility requirements applicable to school employees and instructors in accordance with §501 of this Part. J.When a career practicum includes limited customer-facing services within the instructional scope, the city, parish, or other local school board shall have the authority to regulate campus access consistent with existing safety, supervision, and visitor access policies. K.Student Labor, Safety, and Supervision. Student participants shall: 1.earn academic credit in accordance with this Part; 2.receive wages at or above the applicable minimum wage; 3.be employees of the business partner for wage and workers’ compensation purposes; 4.receive required safety training prior to participation; and 5.be prohibited from engaging in hazardous occupations barred for minors. A student whose behavior prevents the orderly instruction of other students or poses an immediate threat to the safety or physical well-being of any student or teacher shall be immediately removed from the classroom and placed in the custody of the principal or designee. 2.... 3.The plan shall not prohibit or discourage a teacher or school employee from taking disciplinary action, recommending disciplinary action, or completing a form to initiate disciplinary action against a student who violates school policy or who interferes with an orderly education process. 4.A principal or administrator shall not retaliate or take adverse employment action against a teacher or school employee for taking, recommending, or initiating disciplinary action, provided the disciplinary action is taken in accordance with the disciplinary policy adopted by the LEA. 5.... 6.Each school shall annually provide written notice, at the beginning of each school year, to each teacher and school employee, including bus operators, of their right to take or request disciplinary action against a student in accordance with this Section. The notice shall also include eligibility for sick and personal leave in the event that a school employee is injured by a student who committed an assault or battery against a school employee.

I.Assault or Battery on a School Employee. As used in this Subsection, school employee includes any person employed by the school in a full-time, part-time, permanent, or substitute position, including bus operators and school volunteers. 1.A student formally accused of committing an assault or battery, R.S. 14:34.3 or R.S. 14:38.2, on a school employee shall be immediately suspended and removed from the school premises. The student shall be prohibited from returning to the school premises without the benefit of out-of-school suspension procedures, and necessary notifications and procedures shall be implemented as soon as is practicable. 2.A student found guilty by a court of competent jurisdiction or found guilty at a school system suspension hearing of committing a battery or assault on a school employee, shall immediately be recommended for expulsion by the principal or designee in accordance with the provisions of this Section. Any such expulsion shall be for not less than two complete school semesters in an alternative school or alternative educational placement, and the student shall participate in an anger management program. 3.The student shall not be placed at or allowed to attend the same school at which the battered or assaulted school employee is assigned, except when the school system has no other school of suitable grade level for the student to attend. 4.The requirements of this Subsection are applicable when an incident occurs off school property as a continuation of a documented altercation that began at school. 5.All documentation related to the incident shall be included and maintained in the student’s records. The proposed rule change conforms Board of Elementary and Secondary Education (BESE) policy to 32 Acts and one (1) Concurrent Resolution of the 2026 Regular Session. Each provision restates a requirement the legislature has already imposed on schools and school systems, and the Louisiana Department of Education (LDOE) will administer the revisions with existing staff and existing appropriations.
