This filing is necessary to implement the new legislative mandates in Section 53G-9-404, updated as a result of HB 351 passed in the 2026 General Session, by clarifying Department of Health and Human Services (department) oversight of public education vision screenings. Upon drafting this filing, the department also determined it is appropriate to format this substantive change as a repeal and readopt filing because the significant number of markups would have made the rule text difficult to follow if this filing were formatted as an amendment filing.
