whether the rule implements a state statute for the first time: The Board of Land Surveyors (Board) is proposing to readopt with amendment and repeal Lan 400. The Board is proposing to make these changes to bring the rules into alignment with the current structure of the Board and Office of Professional Licensure and Certification (OPLC). The OPLC was granted rulemaking authority over the processing of applications and standards for misconduct while the Board is granted authority to develop criteria for licenses. The changes being proposed largely reflect those changes to the law. By making these changes, the Board is streamlining the licensure process, removing redundancy between Lan and Plc rules, and making the rules easier to understand for licensees and the general public. These rules do implement a state statute for the first time per RSA 310. These rules are set to expire November 1, 2026, but are subject to extension pursuant to RSA 541-A:14-a.
