Summary

The proposed rule amendments in 40:50-1-2 and 40:50-1-3 provide clarity to ignition interlock device manufacturers regarding all device usage conducted in Oklahoma with exception for other state jurisdictions. The proposed amendments in 40:50-1-3 reduce the frequency of retest request prompts to the ignition interlock user while operating a motor vehicle and authorize the Board to suspend the anti circumvention feature requirement to aid an interlock user without risk of device decertification to a manufacturer. The proposed rule amendments in 40:50-3-5 enhance public safety by ensuring the Board may take action against an IDAP participant who leaves an interlock device in permanent lockout for a consecutive period of ninety (90) days or more. The proposed amendments also enhance public safety by authorizing the Board to take immediate action against an IDAP participant reported to be operating a vehicle not equipped with an ignition interlock device when such report or notice is provided by law enforcement.
