Description of Subjects/Issues The proposed rules will: (a) add more definitions (Rule 2); (b) require additional information for specialized day school authorization applications and facility school approval applications (Rules 3.1 and 4.1); (c) clarify the process for the OFS to review applications for specialized day school authorization and applications for facility school approval (Rules 3.2 and 4.2); (d) clarify the processes for the OFS to periodically review and reauthorize specialized day schools (Rule 3.3); (e) add types of situations about which approved facility schools must notify the OFS (Rule 5.1) and clarify the process for the OFS to response to such mandatory notifications (Rule 5.2); (f) add requirements for facility schools to maintain their “approved” status (Rule 6); (g) add more details about OFS’ monitoring of approved facility schools and correction action plans (Rule 7.1); (h) create a complaint system for alleged violations of the Rules (Rule 7.2); (i) clarify requirements related to instructional hours and contact days (Rule 8), individual career and academic plans (Rule 10), graduation requirements and diploma application processes (Rule 11); (j) add requirements related to restraint and seclusion of students (Rule 9); and (k) include other substantive and technical revisions that are raised by stakeholders during the rulemaking process. The revised rules will result in greater communication, clarity, transparency, fairness, quality, accountability, and legal compliance.
