SUMMARIZE IN A CLEAR AND CONCISE MANNER CONTENTS OF CHANGES IN THE RULE AND A STATEMENT OF CIRCUMSTANCES REQUIRING THE RULE: This rule outlines the licensing and administrative fee regulations managed by the WVBOPT. The Board acts as a fully autonomous state licensing agency that receives zero federal funds and zero financial support from the state's general revenue fund, meaning all operating money must be earned entirely through administrative services. To maintain its budget, the rules establish specific pricing structures. This rule will increase the Athletic Trainer Biennial Renewal by $20 to $100, removing the duplicate wallet card/license fee, remove wording from name change section fee remains the same, and increasing individual licensee CE review fee by $5 to $20. The circumstances requiring this rule are due to the increasing cost of administrative and operational expenses necessary to maintain its regulatory duties. The Board modernized it licensing system to an all online database eliminating paper. Prior to the new licensure database the cost was $1,166.64 a year. When we transitioned to our currently online database the yearly fee was approximately $9,708.48. Due to our current contract expiring our cost will now increase sharply to $25,000 with yearly increases of 4%. The Board has been operating over the last few years on a negative budget. The Board has shown a loss since implementing the PT Compact back in 2021. Over time without these fee increases the Board will not be able to sustain itself. SUMMARIZE IN A CLEAR AND CONCISE MANNER THE OVERALL ECONOMIC IMPACT OF THE PROPOSED RULE: A. ECONOMIC IMPACT ON REVENUES OF STATE GOVERNMENT: None-The Board is an autonomous state licensing entity that does not receive general state or federal funding. B. ECONOMIC IMPACT ON SPECIAL REVENUE ACCOUNTS: This rule will increase the Board's special revenue account. Because the Board operates entirely as a self-funded regulatory entity, its special revenue account must independently generate enough revenue to match ongoing operational liabilities without any baseline support from state general funds. If future financial audits reveal that the special revenue account has successfully recovered to the point of holding excess funds that surpass twice the agency's total operating budget, the Board will formally reevaluate the fee schedules. Under those specific fiscal conditions, the Board will actively initiate a new rulemaking process to decrease licensing fees, ensuring that the regulatory financial burden placed on practitioners is kept as low as possible while still maintaining mandatory agency operations. General. 1.1. Scope. -- This legislative rule describes and defines requirements for licensure as well as nature of practice for Athletic Trainers and support personnel. 1.2. Authority. -- W. Va. Code §30-20A-1, et. seq. 1.3. Filing Date. -- April 6, 2021. 1.4. Effective Date. -- May 1, 2021. 1.5. Sunset Provision. – This rule shall terminate and have no further force or effect upon August 1, 2031. §16-6-2. Fees. 2.1. The West Virginia Board of Physical Therapy is an autonomous State Licensing Board Agency and receives no monies from the State’s general revenue fund; nor does it receive any Federal money. All money necessary to efficiently staff and equip a public office must be generated by services performed by the Board in behalf of its licensees or other interested parties. 2.2.
