STATE RURAL UNIVERSAL SERVICE FUND-- ESTABLISHMENT.-- h A.
The commission shall implement and maintain a u » r "state rural universal service fund" to maintain and support t h g e l i universal service that is provided by eligible h r i s telecommunications carriers, including commercial mobile radio h , e h services carriers, as are determined by the commission.
As t u g e b l e 17e , gh used in this section, "universal service" means basic local e e n d 18d i = = o h exchange service, comparable retail alternative services at = = l ] 19b ,d i a º r affordable rates, service pursuant to a low-income telephone ae l r i= 20t e w d m a n o assistance plan and broadband internet access service to td em a: t unserved and underserved areas as determined by the commission.

TheB. fund shall be financed by a surcharge on r e 22 c e r c 23 intrastate retail public telecommunications services to be e a n b 24 determined by the commission, excluding services provided u [ pursuant to a low-income telephone assistance plan billed to .213729.1 - 5 - HSEIC/HB 385 end-user customers by a telecommunications carrier, and excluding all amounts from surcharges, gross receipts taxes, excise taxes, franchise fees and similar charges.
The fund shall be financed by a surcharge on intrastate retail public telecommunications services to be determined by the commission, excluding services provided pursuant to a low-income telephone assistance plan billed to end-user customers by a telecommunications carrier, and excluding all amounts from surcharges, gross receipts taxes, excise taxes, franchise fees and similar charges.
The commission may establish the surcharge as a percentage of intrastate retail public telecommunications h services revenue or as a fixed amount applicable to each u » r communication connection.
For purposes of this section, a t h g e l i "communication connection" means a voice-enabled telephone h r i s access line, wireless voice connection, unique voice over h , e h internet protocol service connection or other uniquely t u g e b l e 17e , gh identifiable functional equivalent as determined by the e e n d 18d i = = o h commission.
Such surcharges shall be competitively and = = l ] 19b ,d i a º r technologically neutral.
Money deposited in the fund is not ae l r i= 20t e w d m a n o public money, and the administration of the fund is not subject td em a: t to the provisions of law regulating public funds.

The eligibility criteria shall not restrict or limit an h r i s eligible telecommunications carrier from receiving federal h , e h universal service support;

The commission may h grant eligible carrier status to a competitive carrier in a g o t hr rural area upon a finding that granting the application is in g e i k the public interest.
In making a public interest finding, the h r i s commission may consider at least the following items:
h , t, (1) the impact of designation of an additional e u g e 17b l e e h eligible carrier on the size of the fund;
e e n d 18d i = = o h (2) the unique advantages and disadvantages of = = l ] 19b ,d i a º e the competitor's service offering;
and ar li = r it 20e w d m a n o (3) any commitments made regarding the quality td em a: t of telephone service.

TheF. commission shall adopt rules, including a r e 22 c e r c 23 provision for variances, for the implementation and e a n b 24 administration of the fund in accordance with the provisions of u [ this section.

The rules shall enumerate the appropriate uses of fund support and any restrictions on the use of fund support by eligible telecommunications carriers.
The rules also shall provide for annual reporting by eligible telecommunications carriers verifying that the reporting carrier continues to meet the requirements for designation as an eligible telecommunications carrier for purposes of the fund and is in h compliance with the commission's rules, including the u » r provisions regarding use of support from the fund.

The commission shall, upon implementation of the h r i s fund, select a neutral third-party administrator to collect, h , e h administer and disburse money from the fund under the t u g e b l e 17e , gh supervision and control of the commission pursuant to e e n d 18d i = = o h established criteria and rules promulgated by the commission.
