The bill adds new restrictions on the Michigan strategic fund regarding the disbursement of economic incentives contingent upon timely reporting to the legislature.

  • Section 7

Sec. 7c. (1) Except as otherwise provided in subsection (2), the Michigan strategic fund shall not disburse, or cause to be disbursed, money for an economic incentive if the Michigan strategic fund is delinquent in submitting a legislatively required report.

This establishes a requirement that the Michigan strategic fund cannot issue economic incentives if they are late in reporting to the legislature.

  • Section 7c

    (2) Subsection (1) does not apply to an economic incentive that is required to be disbursed under a written agreement that was entered into before the effective date of the amendatory act that added this section, unless the written agreement is amended or renewed on or after the effective date of the amendatory act that added this section.

This clause exempts certain pre-existing agreements from the new disbursement restriction.

  • Section 7c

    (3) If the Michigan strategic fund enters into, or amends or renews, a written agreement for an economic incentive on or after the effective date of the amendatory act that added this section, the Michigan strategic fund shall include a provision in the written agreement that money will not be disbursed under the written agreement if the Michigan strategic fund is delinquent in submitting a legislatively required report.

Introduces a requirement for newer agreements to include a clause that enforces the reporting compliance before disbursing funds.

  • Section 7c

    (4) As used in this section: (a) "Economic incentive" means a grant, loan, tax capture or abatement, or other economic assistance or benefit provided under a program administered by, or under which an applicant must seek certification, approval, or other action by, the Michigan strategic fund under this act or another law of this state. (b) "Legislatively required report" means a report required to be submitted by the Michigan strategic fund to the legislature, a member of the legislature, or a committee of the legislature under this act or any other law of this state. (c) "Michigan strategic fund" includes the fund and the authorized officers, employees, and agents of the fund, including the MEDC and its employees.

Defines key terms related to economic incentives and reporting requirements.
