Summary

Requires a landlord that has obtained renter's insurance coverage on behalf of his tenants to include, as part of the summary of the insurance policy or certificate evidencing the coverage as currently required by law, a statement regarding whether the insurance policy contains a waiver of subrogation provision. The bill provides that any failure of the landlord to provide such summary or certificate, or to make available a copy of the insurance policy, shall not affect the validity of the rental agreement.

Plain-language change summary

The recent changes to Bill HB 2304 clarify the rules around renter's insurance when a landlord provides damage insurance for tenants. Now, tenants have the right to choose their own separate renter's insurance policy, but they must inform the landlord and provide proof of coverage. Additionally, if a landlord requires tenants to contribute to insurance costs, this will not be considered a security deposit but treated as part of their rent. This is important because it ensures that tenants remain aware of their insurance options and helps prevent confusion about payments related to rental agreements.
