Notwithstanding the provisions of subsection A of § 22.1-296.1 of the Code of Virginia,Virginia anyand school board may, consistent with the authoritydiscretion granted to thea school board pursuant to § 22.1-307 of the Code of Virginia to employretain aan teacheremployee who hasis been convicted of aan felony,offense employsubsequent anyto individualthe whoemployee's washiring, employed by a school board asmay ofemploy Decemberan 17,individual 2015,who, andat whothe (i)time has been convicted of a felony, with the exceptionindividual's ofhiring, (a)has anybeen felonyconvicted pursuant to subsections B or F of §a 3.2-6570,felony, §provided 18.2-46.2,that §such 18.2-46.3:1,individual §(i) 18.2-46.3:3,was subsectionemployed Cin ofgood §standing 18.2-57,by §a 18.2-57.02,school §board 18.2-60,on subsectionor Cbefore ofDecember §17, 18.2-280,2015; subdivision (1) of § 18.2-355, § 18.2-356, or § 18.2-357;
(b)(ii) anyhas felonybeen listedgranted ina clausesimple (iii)pardon offor thesuch definitionoffense ofby "barrierthe crime"Governor setor forthother inappropriate §authority; 19.2-392.02;
(c)and any(iii) felonyhas offensehad againsthis acivil child;rights restored by the Governor or other appropriate authority.
(d) any act of violence as defined in § 19.2-297.1 or violent felony set forth in subsection C of § 17.1-805;
and (e) any offense for which registration is required pursuant to § 9.1-902, and (ii) has been granted a simple pardon by the Governor and has had his rights restored by the Governor.
