Plain-language change summary

The amendment to Bill SB 665 makes significant changes to the requirements for obtaining a permit to work on horizontal wells. It now specifies that before any land disturbance for well work can begin, a permit must be secured from the secretary, along with detailed applications including information on the well operator and relevant coal operators. This matters because it aims to enhance oversight and safety in well drilling activities, which can have environmental impacts and affect nearby coal operations.

Based upon objective criteria rating an applicant’s compliance history, to be determined and published by the secretary as guidance, the secretary may further reduce the expedited timeframe for approving the permit to less than 45 days, but no less than 30 days, if the secretary determines that the applicant’s compliance history merits such accelerated approval:
(2) Upon entering into an expedited permit process and meeting all the criteria set forth in this article, the secretary shall issue or deny a permit within 45 days of the submission of a permit application under this article, unless the secretary seeks additional information or modification from the applicant, which would toll the 45 day period until the secretary receives the required responsive information from the applicant.
