(2) If any of the following apply and subsections (3) to (5) do not apply, a person who commits a fraudulent insurance act under DAW H01729'25_HB4716_INTR_1 9vdaj0 1 section 4503 that involves a fraudulent claim is guilty of a felony punishable by imprisonment for not more than 5 years or a fine of not more than $10,000.00 or 3 times the amount of the fraudulent claim or claims, whichever is greater, or both imprisonment and a fine:
(2) If any of the following apply and subsections (3) to (5) do not apply, a person who commits a fraudulent insurance act under DAW H01729'25_HB4716_APH_1 nw6qad 1 section 4503 that involves a fraudulent claim is guilty of a felony punishable by imprisonment for not more than 5 years or a fine of not more than $10,000.00 or 3 times the amount of the fraudulent claim or claims, whichever is greater, or both imprisonment and a fine:
