Plain-language change summary

In the latest version of SB 1003, specific language about the responsibilities of managed care plans regarding emergency services has been clarified. The amendment emphasizes that these plans must pay for necessary emergency services, while also noting that they can apply copayments or deductibles as per the enrollee's health insurance policy. This change matters because it reinforces the obligation of managed care plans to cover emergency care without requiring prior approval, which can help ensure that patients receive timely and appropriate treatment in critical situations.

The bill amends existing law to clarify the payment responsibilities of managed care plans for emergency services provided by licensed emergency medical services agencies.

  • Section 2116

[The managed care plan shall pay all reasonably necessary costs associated with the emergency services provided during the period of the emergency.] → The managed care plan shall pay all reasonably necessary costs associated with emergency services provided during the period of emergency, subject to all copayments, coinsurances or deductibles.

This change modifies the payment terms for emergency services, making it subject to copayments, coinsurances, or deductibles.

  • Section 2116

For emergency services rendered by a licensed emergency medical services agency, as defined in 35 PA.C.S. § 8103 (relating to definitions), that has the ability to transport patients or is providing and billing for emergency services under an agreement with an emergency medical services agency that has that ability, the managed care plan may not deny a claim for payment solely because the enrollee did not require transport or refused to be transported.

This addition ensures that managed care plans cannot deny payment for emergency services based on the enrollee's transport status.
