(2) If the civil action described under subsection (1) relates to a state institution of higher education or an affiliate organization knowingly, willfully, or negligently failing to disclose a gift under section 13, the state institution of higher education or affiliate organization may be ordered to pay a civil JHM H01658'25 (H-1)_HB4239_APH_1 xvm2oj fine in an amount equal to 105% of the value of the undisclosed gift, payable only from nonpublic funds.
