EXEMPT (Reprinted with amendments adopted on April 16, 2025) FIRST REPRINT S.B.
Sections 8 and 11 of this bill provide for the confidentiality of any personally identifiable information, proprietary financial information, trade secret or other - *SB47**SB47_R1* – 2 – confidential information that is submitted to the Commissioner pursuant to section 8.
The Commissioner and the person or entity with whom the Commissioner enters into a contract pursuant to subsection 1 may enter into a contract or otherwise collaborate with a non-profit organization that specializes in data analytics relating to health - *SB47**SB47_R1* – 3 – insurance as necessary to conduct the study pursuant to subsection 1.
(1) The adequacy of the workforce providing behavioral health care in this State;
(2) The resultspotential and, if applicable, actual outcomes of having an inadequate workforce providing behavioral health care, including, without limitation:
and - *SB47**SB47_R1* – 4 – (b) Consideration for the limited pool of health insurers in this State.
(b) TheExcept Departmentwhere offederal Healthlaw andprohibits Humanthe ServicesCommissioner andfrom eachrequiring divisionthe andsubmission officeof thereof;such information, a self-funded multiple employer welfare arrangement that:
(c)(1) TheHas Division;been issued a certificate of authority by the Commissioner;
and (d)(2) AnyProvides publichealth bodycoverage establishedor bybenefits theto Commissioner.residents of this State;
(c) The Department of Health and Human Services and each division and office thereof;
(d) The Division;
and (e) Any public body established by the Commissioner.
AExcept as otherwise provided in paragraph (b) of subsection 1, a provider of health coverage for federal employees, a provider of health coverage that is subject to the Employee Retirement Income Security Act of 1974 or the administrator of a Taft-Hartley trust formed pursuant to 29 U.S.C.
The Commissioner and the person or entity shall - *SB47_R1* – 5 – comply with the provisions of subsection 4 of this section and subsection 5 of NRS 439B.855 with respect to any such data.
Such information must not be included in a report compiled pursuant to - *SB47* – 5 – section 10 of this act or otherwise disclosed to any other person or entity.

As used in this section, “multiple employer welfare arrangement” has the meaning ascribed to it in 29 U.S.C.
§ 1002(40).

Nothing in this subsection requires a governmental entity - *SB47_R1* – 9 – to provide a copy of a public record in an electronic format or by means of an electronic medium if:
(a) Shall not refuse to provide a copy of that public record in the medium that is requested because the officer, employee or agent has -already *SB47*prepared –or 9would –prefer to provide the copy in a different medium.
