Plain-language change summary

Recent amendments to HB 4769 clarify the process regarding tax deeds, which are certificates issued to buyers after a property tax sale. Now, property owners can contest tax deeds if they can provide evidence that the taxes were paid, the property was exempt, or that the deed was acquired through fraud. This change is important because it provides protections for property owners against wrongful tax sales, ensuring fair treatment in these situations.

The Property Tax Code is amended by changing Section 22-45 as follows:

Mailed notice of application for judgment and sale.
22-45.
Not less than 15 days before the date of application for judgment and sale of delinquent properties, the county collector shall mail, by registered or certified mail, a notice of the forthcoming application for judgment and sale to the person shown by the current collector’s warrant book to be the party in whose name the taxes were last assessed or to the current owner of record and, if applicable, to the party specified under Section 15-170.
Tax deed incontestable unless order appealed or relief petitioned.
The notice shall include the intended dates of application for judgment and sale and commencement of the sale, and a description of the properties.
Tax deeds issued under Section 22-40 are incontestable except by appeal from the order of the court directing the county clerk to issue the tax deed.
The county collector must present proof of the mailing to the court along with the application for judgement.
However, relief from such order may be had under Section 2-1401 of the Code of Civil Procedure in the same manner and to the same extent as may be had under that Section with respect to final orders and judgments in other proceedings.
In counties with less than 3,000,000 inhabitants, a copy of this notice shall also be mailed by the county collector by registered or certified mail to any lienholder of record who HB4769 - 2 - LRB095 15330 BDD 41318 b annually requests a copy of the notice.
The grounds for relief under Section 2-1401 shall be limited to:
The failure of the county collector to mail a notice or its non-delivery to the lienholder shall not affect the validity of the judgment.
(1) proof that the taxes were paid prior to sale;
In counties with 3,000,000 or more inhabitants, notice shall not be mailed to any person when, under Section 14-15, a certificate of error has been executed by the county assessor or by both the county assessor and board of appeals (until the first Monday in December 1998 and the board of review beginning the first Monday in December 1998 and thereafter), except as provided by court order under Section 21-120.
(2) proof that the property was exempt from taxation;
The collector shall collect $10 from the proceeds of each sale to cover the costs of registered or certified mailing and the costs of advertisement and publication.
(3) proof by clear and convincing evidence that the tax deed had been procured by fraud or deception by the tax purchaser or his or her assignee;
If a taxpayer pays the taxes on the property after the notice of the forthcoming application for judgment and sale is mailed but before the sale is made, then the collector shall collect $10 from the taxpayer to cover the costs of registered or certified mailing and the costs of advertisement and publication.
or (4) proof by a person or party holding a recorded ownership or other recorded interest in the property that HB4769 Engrossed - 2 - LRB095 15330 BDD 41318 b he or she was not named as a party in the publication notice as set forth in Section 22-20, and that the tax purchaser or his or her assignee did not make a diligent inquiry and effort to serve that person or party with the notices required by Sections 22-10 through 22-30.
Any mortgagee that receives a copy of the notice under this Section from the county collector must, within 7 business days after the mortgagee receives the notice, forward, by registered or certified mail, a copy of the notice to each mortgagor of the property referred to in the notice at the last known address of each mortgagor as shown on the records of the mortgagee.
In cases of the sale of homestead property in counties with 3,000,000 or more inhabitants, a tax deed may also be voided by the court upon petition, filed not more than 3 months after an order for tax deed was entered, if the court finds that the property was owner occupied on the expiration date of the period of redemption and that the order for deed was effectuated pursuant to a negligent or willful error made by an employee of the county clerk or county collector during the period of redemption from the sale that was reasonably relied upon to the detriment of any person having a redeemable interest.
The mortgagee may collect a fee of up to $10 from the mortgagor for the administrative costs of forwarding the HB4769 - 3 - LRB095 15330 BDD 41318 b notice.
In such a case, the tax purchaser shall be entitled to the original amount required to redeem the property plus interest from the sale as of the last date of redemption together with costs actually expended subsequent to the expiration of the period of redemption and reasonable attorney’s fees, all of which shall be dispensed from the fund created by Section 21-295.
In those cases of error where the court vacates the tax deed, it may award the petitioner reasonable attorney’s fees and court costs actually expended, payable from that fund.
The court hearing a petition filed under this Section or Section 2-1401 of the Code of Civil HB4769 Engrossed - 3 - LRB095 15330 BDD 41318 b Procedure may concurrently hear a petition filed under Section 21-295 and may grant relief under either Section.
