(a) Except as provided by Section 39.02301(m) [39.023(e)], a parent is entitled to access to a copy of each state assessment instrument administered under Section 39.023 to the parent’s child.
1-34 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
(b) AAThe agency shall make available to a parent the results of each state assessment instrument administered under Section 39.023 to the parent’s child.
1-35 ARTICLE 1.
The results must be accessible by one click from the home page of an Internet website maintained by the 89S20038 CMO-F 1 S.B.ANo.A9 agency.
TRANSITION TO INSTRUCTIONALLY SUPPORTIVE ASSESSMENT 1-36 PROGRAM 1-37 SECTIONA1.001.AASection 26.005, Education Code, is amended 1-38 to read as follows:
Identifying information that is necessary to access a child s results must:
1-39 Sec.A26.005.AAACCESS TO STATE ASSESSMENTS AND ASSESSMENT 1-40 RESULTS.
(1)AAmeet agency security protocols;
(a) Except as provided by Section 39.02301(m) 1-41 [39.023(e)], a parent is entitled to access to a copy of each state 1-42 assessment instrument administered under Section 39.023 to the 1-43 parent s child.
(2)AAbe unique to the child;
1-44 (b)AAThe agency shall make available to a parent the results 1-45 of each state assessment instrument administered under Section 1-46 39.023 to the parent s child.
and (3)AAbe under the control of the child’s parent without the need to secure additional information from a third party.
The results must be accessible by one 1-47 click from the home page of an Internet website maintained by the 1-48 agency.
(c)AAEach school district and open-enrollment charter school shall provide to a parent of a child enrolled at the district or school access to the Internet website described by Subsection (b) through a parent portal maintained by the district or school and notify the parent regarding that access each time the agency makes available the results of an assessment instrument administered to the parent’s child.

(1)AAprovides for progress monitoring;
1-61 SECTIONA1.002.AASection 39.022, Education Code, is amended S.B.ANo.A9 2-1 to read as follows:
(2)AAis balanced, innovative, and streamlined;
2-2 Sec.A39.022.AAINSTRUCTIONALLY SUPPORTIVE ASSESSMENT 2-3 PROGRAM.
and (3)AAis based on essential knowledge and skills adopted by the State Board of Education under Section 28.002 [knowledge- and skills-based to ensure school accountability for student achievement that achieves the goals provided under Section 4.002].
(a) To ensure school accountability for student 2-4 achievement that achieves the goals provided under Section 4.002, 2-5 the agency [The State Board of Education by rule] shall create and 2-6 implement an instructionally supportive [a] statewide assessment 2-7 program that:
S.B.ANo.A9 (b)AAThe primary objective of an instructionally supportive assessment program created and implemented under this section is to benefit the students of this state.
2-8 (1)AAprovides for progress monitoring;
(c)AAThe agency [After adopting rules under this section, the State Board of Education] shall consider the importance of maintaining stability in the instructionally supportive [statewide] assessment program when modifying the program [adopting any subsequent modification of the rules].
2-9 (2)AAis balanced, innovative, and streamlined;
(d)A[(b)]AAIt is the policy of this state that the instructionally supportive [statewide] assessment program be designed to:
and 2-10 (3)AAis based on essential knowledge and skills adopted 2-11 by the State Board of Education under Section 28.002 [knowledge- 2-12 and skills-based to ensure school accountability for student 2-13 achievement that achieves the goals provided under Section 4.002].
(1)AAprovide information regarding student academic achievement and learning progress to:
2-14 (b)AAThe primary objective of an instructionally supportive 2-15 assessment program created and implemented under this section is to 2-16 benefit the students of this state.
(A)AApublic schools for the purpose of improving student instruction [provide assessment instruments that are as short as practicable];
2-17 (c)AAThe agency [After adopting rules under this section, the 2-18 State Board of Education] shall consider the importance of 2-19 maintaining stability in the instructionally supportive 2-20 [statewide] assessment program when modifying the program 2-21 [adopting any subsequent modification of the rules].
(B)AAstudents, parents, and teachers for the purpose of guiding learning objectives;
2-22 (d)A[(b)]AAIt is the policy of this state that the 2-23 instructionally supportive [statewide] assessment program be 2-24 designed to:
and (C)AAeducation researchers for the purpose of comparing student academic achievement and learning progress data at the national and statewide levels;
2-25 (1)AAprovide information regarding student academic 2-26 achievement and learning progress to:
(2)AAevaluate the achievement level and learning progress of each assessed student in reading language arts, mathematics, science, and social studies;
2-27 (A)AApublic schools for the purpose of improving 2-28 student instruction [provide assessment instruments that are as 2-29 short as practicable];
(3)AAprovide information to the agency for the purpose of making decisions regarding public school accountability, campus recognition, and the improvement of public school operations and S.B.ANo.A9 management;
2-30 (B)AAstudents, parents, and teachers for the 2-31 purpose of guiding learning objectives;
(4)AAidentify the educational strengths and needs of individual students and the readiness of those students to be promoted to the next grade level or to graduate from high school;
and 2-32 (C) AAeducation researchers for the purpose of 2-33 comparing student academic achievement and learning progress data 2-34 at the national and statewide levels;
(5)AAassess whether educational goals and curricular standards are being met at the campus, district, and state levels;
2-35 (2)AAevaluate the achievement level and learning 2-36 progress of each assessed student in reading language arts, 2-37 mathematics, science, and social studies;
(6)AAprovide information to help evaluate and develop educational programs and policies;
2-38 (3)AAprovide information to the agency for the purpose 2-39 of making decisions regarding public school accountability, campus 2-40 recognition, and the improvement of public school operations and 2-41 management;
and (7)AAprovide instructional staff with immediate, actionable, and useful information regarding student achievement of standards and benchmarks that may be used to improve the staff’ s delivery of student instruction [and [(2)AAminimize the disruption to the educational program].
2-42 (4)AAidentify the educational strengths and needs of 2-43 individual students and the readiness of those students to be 2-44 promoted to the next grade level or to graduate from high school;
(e)AAEach school district and open-enrollment charter school shall administer assessment instruments as required under this chapter in accordance with the instructionally supportive assessment program.
2-45 (5)AAassess whether educational goals and curricular 2-46 standards are being met at the campus, district, and state levels;
SECTIONA1.003.AASubchapter B, Chapter 39, Education Code, is amended by adding Sections 39.0225 and 39.0226 to read as follows:
2-47 (6)AAprovide information to help evaluate and develop 2-48 educational programs and policies;
Sec.A39.0225.AATRANSITION OF ASSESSMENT PROGRAM.
and 2-49 (7)AAprovide instructional staff with immediate, 2-50 actionable, and useful information regarding student achievement 2-51 of standards and benchmarks that may be used to improve the staff ’s 2-52 delivery of student instruction [and 2-53 [(2)AAminimize the disruption to the educational 2-54 program].
(a) Except as otherwise provided by this section, not later than the beginning of the 2027-2028 school year, the agency shall transition the program for assessment instruments administered under this subchapter from the State of Texas Assessment of Academic Readiness (STAAR) assessment program to the instructionally supportive assessment program described by Section 39.022.
2-55 (e)AAEach school district and open-enrollment charter school 2-56 shall administer assessment instruments as required under this 2-57 chapter in accordance with the instructionally supportive 2-58 assessment program.
S.B.ANo.A9 (b)AAThe agency shall contract with a nationally recognized provider of assessment instruments for the purpose of making the transition described by Subsection (a).
2-59 SECTIONA1.003.AASubchapter B, Chapter 39, Education Code, is 2-60 amended by adding Sections 39.0225 and 39.0226 to read as follows:
(c)AAStudents shall continue to be assessed under the State of Texas Assessment of Academic Readiness (STAAR) assessment program until the instructionally supportive assessment program described by Section 39.022 is available beginning with the 2027-2028 school year.
2-61 Sec.A39.0225.AATRANSITION OF ASSESSMENT PROGRAM.

(d)AADuring the 2025-2026, 2026-2027, and 2027-2028 school years, the agency, school districts, and open-enrollment charter schools shall conduct any field testing of questions for assessment instruments proposed to be adopted or developed under Section 39.023 necessary to implement the transition under this section.
(a) 2-62 Except as otherwise provided by this section, not later than the 2-63 beginning of the 2027-2028 school year, the agency shall transition 2-64 the program for assessment instruments administered under this 2-65 subchapter from the State of Texas Assessment of Academic Readiness 2-66 (STAAR) assessment program to the instructionally supportive 2-67 assessment program described by Section 39.022.
(e)AANot later than February 15, 2027, the agency shall submit to the governor, the lieutenant governor, the speaker of the house of representatives, and the chairs of the standing legislative committees with primary jurisdiction over public school assessments a report regarding the status of the implementation of the instructionally supportive assessment program described by Section 39.022.
2-68 (b)AAThe agency shall contract with a nationally recognized 2-69 provider of assessment instruments for the purpose of making the S.B.ANo.A9 3-1 transition described by Subsection (a).
(f) AAThis section expires September 1, 2029.
3-2 (c)AAStudents shall continue to be assessed under the State 3-3 of Texas Assessment of Academic Readiness (STAAR) assessment 3-4 program until the instructionally supportive assessment program 3-5 described by Section 39.022 is available beginning with the 3-6 2027-2028 school year.
Sec.
3-7 (d)AADuring the 2025-2026, 2026-2027, and 2027-2028 school 3-8 years, the agency, school districts, and open-enrollment charter 3-9 schools shall conduct any field testing of questions for assessment 3-10 instruments proposed to be adopted or developed under Section 3-11 39.023 necessary to implement the transition under this section.
A39.0226.AAASSESSMENT INSTRUMENT STUDY.
3-12 (e)AANot later than February 15, 2027, the agency shall 3-13 submit to the governor, the lieutenant governor, the speaker of the 3-14 house of representatives, and the chairs of the standing 3-15 legislative committees with primary jurisdiction over public 3-16 school assessments a report regarding the status of the 3-17 implementation of the instructionally supportive assessment 3-18 program described by Section 39.022.
(a) The commissioner shall enter into a memorandum of understanding with a public institution of higher education to conduct a study on items proposed to be included in an assessment instrument required to be administered under Section 39.023(a) under the instructionally supportive assessment program described by Section 39.022.
3-19 (f)AAThis section expires September 1, 2029.
The S.B.ANo.A9 study must determine whether, for each item that is designed to be on grade level, the item:
3-20 Sec.A39.0226.AAASSESSMENT INSTRUMENT STUDY.
(1)AAis written at a reading level appropriate for students at that grade level;
(a) The 3-21 commissioner shall enter into a memorandum of understanding with a 3-22 public institution of higher education to conduct a study on items 3-23 proposed to be included in an assessment instrument required to be 3-24 administered under Section 39.023(a) under the instructionally 3-25 supportive assessment program described by Section 39.022.
and (2)AAincludes only:
The 3-26 study must determine whether, for each item that is designed to be 3-27 on grade level, the item:
(A)AApassages, questions, answers, or other content aligned with the essential knowledge and skills adopted by the State Board of Education under Section 28.002 for the applicable subject for that grade level or a previous grade level;
3-28 (1)AAis written at a reading level appropriate for 3-29 students at that grade level;
and (B)AApassages written at a reading level not higher than that grade level.
and 3-30 (2)AAincludes only:
(b) AANot later than December 1, 2028, the commissioner shall submit to the legislature and the chairs of the standing legislative committees with primary jurisdiction over primary and secondary education a report that includes the results of the study conducted under Subsection (a).
3-31 (A)AApassages, questions, answers, or other 3-32 content aligned with the essential knowledge and skills adopted by 3-33 the State Board of Education under Section 28.002 for the 3-34 applicable subject for that grade level or a previous grade level;
(c)AAThis section expires December 31, 2028.
3-35 and 3-36 (B)AApassages written at a reading level not 3-37 higher than that grade level.
SECTION A1.004.AASection 39.023, Education Code, is amended by amending Subsections (a), (a-3), (c), (h), (i), and (l) and adding Subsection (q) to read as follows:
3-38 (b)AANot later than December 1, 2028, the commissioner shall 3-39 submit to the legislature and the chairs of the standing 3-40 legislative committees with primary jurisdiction over primary and 3-41 secondary education a report that includes the results of the study 3-42 conducted under Subsection (a).
(a)AAIn creating and implementing the instructionally supportive assessment program under Section 39.022, the [The] agency shall adopt or develop appropriate beginning-of-year, middle-of-year, and end-of-year [criterion-referenced] assessment instruments designed to assess essential knowledge and skills in reading language arts, mathematics, social studies, and science.
3-43 (c)AAThis section expires December 31, 2028.
S.B.ANo.A9 Except as provided by Subsection (a-2), all students, other than students assessed under Subsection (b) or (l) or exempted under Section 39.027, shall be assessed in:
3-44 SECTIONA1.004.AASection 39.023, Education Code, is amended 3-45 by amending Subsections (a), (a-3), (c), (h), (i), and (l) and 3-46 adding Subsection (q) to read as follows:
(1)AAmathematics, annually in grades three through eight;
3-47 (a)AAIn creating and implementing the instructionally 3-48 supportive assessment program under Section 39.022, the [The] 3-49 agency shall adopt or develop appropriate beginning-of-year, 3-50 middle-of-year, and end-of-year [criterion-referenced] assessment 3-51 instruments designed to assess essential knowledge and skills in 3-52 reading language arts, mathematics, social studies, and science.
(2)AAreading language arts, annually in grades three through eight;
3-53 Except as provided by Subsection (a-2), all students, other than 3-54 students assessed under Subsection (b) or (l) or exempted under 3-55 Section 39.027, shall be assessed in:
(3)AAsocial studies, in grade eight;
3-56 (1)AAmathematics, annually in grades three through 3-57 eight;
(4)AAscience, in grades five and eight;
3-58 (2)AAreading language arts, annually in grades three 3-59 through eight;
and (5)AAany other subject and grade required by federal law.
3-60 (3)AAsocial studies, in grade eight;
(a-3)AAThe agency may not adopt or develop an [a criterion-referenced] assessment instrument under this section based on common core state standards as defined by Section 28.002(b-1).
3-61 (4)AAscience, in grades five and eight;
This subsection does not prohibit the use of college advanced placement tests or international baccalaureate examinations as those terms are defined by Section 28.051.
and 3-62 (5)AAany other subject and grade required by federal 3-63 law.
(c)AAThe agency shall also adopt or develop end-of-course assessment instruments for secondary-level courses in Algebra I, biology, English I, English II, and United States history and provide for the availability of optional beginning-of-year and middle-of-year assessment instruments for those courses.
3-64 (a-3)AAThe agency may not adopt or develop an [a 3-65 criterion-referenced] assessment instrument under this section 3-66 based on common core state standards as defined by Section 3-67 28.002(b-1).
The Algebra I end-of-course assessment instrument must be administered with the aid of technology, but may include one or more parts that prohibit the use of technology.
This subsection does not prohibit the use of college 3-68 advanced placement tests or international baccalaureate 3-69 examinations as those terms are defined by Section 28.051.
The English I and English II end-of-course assessment instruments must each assess essential knowledge and skills in both reading and writing and must provide a S.B.ANo.A9 single score.
S.B.ANo.A9 4-1 (c)AAThe agency shall also adopt or develop end-of-course 4-2 assessment instruments for secondary-level courses in Algebra I, 4-3 biology, English I, English II, and United States history and 4-4 provide for the availability of optional beginning-of-year and 4-5 middle-of-year assessment instruments for those courses.
[A school district shall comply with State Board of Education rules regarding administration of the assessment instruments listed in this subsection.
The 4-6 Algebra I end-of-course assessment instrument must be administered 4-7 with the aid of technology, but may include one or more parts that 4-8 prohibit the use of technology.
If a student is in a special education program under Subchapter A, Chapter 29, the student’ s admission, review, and dismissal committee shall determine whether any allowable modification is necessary in administering to the student an assessment instrument required under this subsection.
The English I and English II 4-9 end-of-course assessment instruments must each assess essential 4-10 knowledge and skills in both reading and writing and must provide a 4-11 single score.
The State Board of Education shall administer the assessment instruments.
[A school district shall comply with State Board of 4-12 Education rules regarding administration of the assessment 4-13 instruments listed in this subsection.
An end-of-course assessment instrument may be administered in multiple parts over more than one day.
If a student is in a special 4-14 education program under Subchapter A, Chapter 29, the student’ s 4-15 admission, review, and dismissal committee shall determine whether 4-16 any allowable modification is necessary in administering to the 4-17 student an assessment instrument required under this subsection.
The State Board of Education shall adopt a schedule for the administration of end-of-course assessment instruments that complies with the requirements of Subsection (c-3).] (h) AAThe agency shall notify school districts and campuses of the results of assessment instruments administered under this section in accordance with the timeline provided by Section 39.02301 [not later than the 21st day after the date the assessment instrument is administered].
4-18 The State Board of Education shall administer the assessment 4-19 instruments.
An end-of-course assessment instrument may be 4-20 administered in multiple parts over more than one day.
The State 4-21 Board of Education shall adopt a schedule for the administration of 4-22 end-of-course assessment instruments that complies with the 4-23 requirements of Subsection (c-3).] 4-24 (h)AAThe agency shall notify school districts and campuses of 4-25 the results of assessment instruments administered under this 4-26 section in accordance with the timeline provided by Section 4-27 39.02301 [not later than the 21st day after the date the assessment 4-28 instrument is administered].
(1)AAdisclose to each district teacher the results of assessment instruments administered to students taught by the teacher in the subject for the school year in which the assessment instrument is administered;
4-29 (1)AAdisclose to each district teacher the results of 4-30 assessment instruments administered to students taught by the 4-31 teacher in the subject for the school year in which the assessment 4-32 instrument is administered;
and (2)AAprovide to the parent of a student enrolled in the district:
and 4-33 (2)AAprovide to the parent of a student enrolled in the 4-34 district:
(A)AAthe results of each assessment instrument administered under this section to the student;
4-35 (A) AAthe results of each assessment instrument 4-36 administered under this section to the student;
and (B)AAinstructions for accessing any online portal S.B.ANo.A9 maintained by the agency that provides results of assessment instruments administered to the student.
and 4-37 (B) AAinstructions for accessing any online portal 4-38 maintained by the agency that provides results of assessment 4-39 instruments administered to the student.
(i) AAThe provisions of this section and Section 39.02301[, except Subsection (d),] are subject to modification by rules adopted under Section 39.001 [39.022].
4-40 (i)AAThe provisions of this section and Section 39.02301[, 4-41 except Subsection (d),] are subject to modification by rules 4-42 adopted under Section 39.001 [39.022].
Each assessment instrument adopted or developed under those rules [and each assessment instrument required under Subsection (d)] must be reliable and valid and must meet any applicable federal requirements for measurement of student progress.
Each assessment instrument 4-43 adopted or developed under those rules [and each assessment 4-44 instrument required under Subsection (d)] must be reliable and 4-45 valid and must meet any applicable federal requirements for 4-46 measurement of student progress.
(l) AAThe agency [State Board of Education] shall adopt rules for the administration of the assessment instruments adopted under Subsection (a) in Spanish to emergent bilingual students in grades three through five, as defined by Section 29.052, whose primary language is Spanish, and who are not otherwise exempt from the administration of an assessment instrument under Section 39.027(a)(1) or (2).

(q)AAThe agency shall approve a list of alternative norm-referenced assessment instruments that meet the requirements of this subchapter and that a school district or open-enrollment charter school may administer in place of a beginning-of-year or S.B.ANo.A9 middle-of-year assessment instrument adopted or developed under this section.
4-61 (q)AAThe agency shall approve a list of alternative 4-62 norm-referenced assessment instruments that meet the requirements 4-63 of this subchapter and that a school district or open-enrollment 4-64 charter school may administer in place of a beginning-of-year or 4-65 middle-of-year assessment instrument adopted or developed under 4-66 this section.

(f) AAIn setting performance levels for a criterion-referenced assessment instrument adopted or developed under Subsection (e), the commissioner shall implement procedures to maintain the validity and reliability of the assessment instrument, including procedures for field testing items approved by the teacher committees described by Subsection (c).
6-9 (f)AAIn setting performance levels for a 6-10 criterion-referenced assessment instrument adopted or developed 6-11 under Subsection (e), the commissioner shall implement procedures 6-12 to maintain the validity and reliability of the assessment 6-13 instrument, including procedures for field testing items approved 6-14 by the teacher committees described by Subsection (c).
Except as necessary to comply with college readiness recommendations made by the commissioner of higher education under Section 39.0241(a-1), the commissioner shall ensure the performance levels are set at levels consistent with performance levels set for previous school years, including by implementing procedures that equate the performance levels or by conducting standards-setting processes.

7-22 (m)AAAt least every third year, the agency shall release the 7-23 questions and answer keys to each end-of-year and end-of-course 7-24 assessment instrument administered under Section 39.023, excluding 7-25 any assessment instrument administered to a student for the purpose 7-26 of retaking the assessment instrument or a question on an 7-27 assessment instrument that will be reused for other assessment 7-28 instruments, after the last time the instrument is administered for 7-29 that school year.

12-34 (d)AADuring the three years following a determination under 12-35 Subsection (c) that an industry certification is no longer eligible 12-36 for purposes of Section 39.053(c)(1)(B)(v), a school district may 12-37 receive the benefit of achievement indicators based on that 12-38 industry certification for purposes of Section 39.053(c) only for a 12-39 cohort of students who:
(1)AAwere participating in the program of study aligned with that certification during the school year the agency determines the certification is no longer eligible;
12-40 (1)AAwere participating in the program of study aligned 12-41 with that certification during the school year the agency 12-42 determines the certification is no longer eligible;
and (2)AAearn the certification within the three-year period.

(a) The agency shall 12-47 collect for reporting purposes only information provided by school 12-48 districts and open-enrollment charter schools under Subsection (b) 12-49 regarding local indicators of student engagement and workforce 12-50 development.

12-51 (b)AAA school district or open-enrollment charter school 12-52 may, but is not required to, provide to the agency information 12-53 regarding the following indicators at a district or school campus 12-54 that serves students in prekindergarten through eighth grade:

12-55 (1)AAan indicator that accounts for the percentage of 12-56 students participating in school-sponsored extracurricular or 12-57 cocurricular student activities consistent with the findings of the 12-58 extracurricular and cocurricular student activity indicator study 12-59 required under Section 39.0533, as that section existed immediately 12-60 before September 1, 2023;
(1)AAan indicator that accounts for the percentage of students participating in school-sponsored extracurricular or cocurricular student activities consistent with the findings of the extracurricular and cocurricular student activity indicator study required under Section 39.0533, as that section existed immediately before September 1, 2023;
12-61 (2)AAfor campuses that serve students in 12-62 prekindergarten, an indicator that accounts for student 12-63 participation in full-day prekindergarten programs;
(2)AAfor campuses that serve students in prekindergarten, an indicator that accounts for student participation in full-day prekindergarten programs;
12-64 (3)AAfor campuses that serve students in kindergarten 12-65 through fifth grade, an indicator that accounts for teacher 12-66 completion rates of the literacy achievement academies and 12-67 mathematics achievement academies established under Sections 12-68 21.4552 and 21.4553;
(3)AAfor campuses that serve students in kindergarten through fifth grade, an indicator that accounts for teacher completion rates of the literacy achievement academies and mathematics achievement academies established under Sections 21.4552 and 21.4553;
12-69 (4)AAan indicator that accounts for students in grades S.B.ANo.A9 13-1 six, seven, and eight who successfully complete a career and 13-2 technology course approved for purposes of the career and 13-3 technology education allotment under Section 48.106;
(4)AAan indicator that accounts for students in grades six, seven, and eight who successfully complete a career and technology course approved for purposes of the career and technology education allotment under Section 48.106;
and 13-4 (5)AAan indicator that accounts for students who 13-5 successfully complete and receive credit for a course designated 13-6 for a grade higher than the grade in which the student is enrolled.
and (5)AAan indicator that accounts for students who successfully complete and receive credit for a course designated for a grade higher than the grade in which the student is enrolled.
13-7 (c)AAThe agency shall post the information collected under 13-8 Subsection (a) on the Texas School Accountability Dashboard 13-9 developed under Section 39.309.

and 13-30 (5)AAa representative of each stakeholder group 13-31 described by Section 39.053(f).
(4)AAa staff member from the office of each chair of a standing legislative committee with primary jurisdiction over primary and secondary education;
13-32 (c)AAThe committee shall provide minutes of each committee 13-33 meeting within a reasonable time after the meeting to the governor, 13-34 the lieutenant governor, the speaker of the house of 13-35 representatives, and each member of the standing legislative 13-36 committees with primary jurisdiction over primary and secondary 13-37 education.

S.B.ANo.A9 SECTIONA2.004.AASection 39.054, Education Code, is amended by amending Subsections (a), (a-3), (a-4), and (a-5) and adding Subsections (a-6), (a-7), and (c) to read as follows:
In 13-45 addition to the overall performance rating, each school year, the 13-46 commissioner shall assign each district and campus a separate 13-47 domain performance rating of A, B, C, D, or F for each domain under 13-48 Section 39.053(c).
(a)AAExcept as provided by Subsection (a-4), the commissioner shall adopt rules to evaluate school district and campus performance and, each school year, assign each district and campus an overall performance rating of A, B, C, D, or F.
An overall or domain performance rating of A 13-49 reflects exemplary performance.
In addition to the overall performance rating, each school year, the commissioner shall assign each district and campus a separate domain performance rating of A, B, C, D, or F for each domain under Section 39.053(c).
An overall or domain performance 13-50 rating of B reflects recognized performance.
An overall or domain performance rating of A reflects exemplary performance.
An overall or domain 13-51 performance rating of C reflects acceptable performance.
An overall or domain performance rating of B reflects recognized performance.
An 13-52 overall or domain performance rating of D reflects performance that 13-53 needs improvement.
An overall or domain performance rating of C reflects acceptable performance.
An overall or domain performance rating of F 13-54 reflects unacceptable performance.
An overall or domain performance rating of D reflects performance that needs improvement.
A district may not receive an 13-55 overall or domain performance rating of A if the district includes 13-56 any campus with a corresponding overall or domain performance 13-57 rating of D or F.
An overall or domain performance rating of F reflects unacceptable performance.
If a school district has been approved under 13-58 Section 39.0544 to assign campus performance ratings and the 13-59 commissioner has not assigned a campus an overall performance 13-60 rating of D or F, the commissioner shall assign the campus an 13-61 overall performance rating based on the school district assigned 13-62 performance rating under Section 39.0544.
A district may not receive an overall or domain performance rating of A if the district includes any campus with a corresponding overall or domain performance rating of D or F.
13-63 (a-3)AAExcept as provided by Subsection (c), not [Not] later 13-64 than August 15 of each year, the following information shall be made 13-65 publicly available as provided by rules adopted under this 13-66 section:
If a school district has been approved under Section 39.0544 to assign campus performance ratings and the commissioner has not assigned a campus an overall performance rating of D or F, the commissioner shall assign the campus an overall performance rating based on the school district assigned performance rating under Section 39.0544.
13-67 (1)AAthe performance ratings for each school district 13-68 and campus;
(a-3)AAExcept as provided by Subsection (c), not [Not] later than August 15 of each year, the following information shall be made S.B.ANo.A9 publicly available as provided by rules adopted under this section:
and 13-69 (2)AAif applicable, the number of consecutive school S.B.ANo.A9 14-1 years of unacceptable performance ratings for each district and 14-2 campus.
(1)AAthe performance ratings for each school district and campus;
14-3 (a-4)AANotwithstanding any other law and except as provided 14-4 by Subsection (a-6), the commissioner may assign a school district 14-5 or campus an overall performance rating of "Not Rated" if the 14-6 commissioner determines that the assignment of a performance rating 14-7 of A, B, C, D, or F would be inappropriate because:
and (2)AAif applicable, the number of consecutive school years of unacceptable performance ratings for each district and campus.
14-8 (1)AAthe district or campus is located in an area that 14-9 is subject to a declaration of a state of disaster under Chapter 14-10 418, Government Code, and due to the disaster, performance 14-11 indicators for the district or campus are difficult to measure or 14-12 evaluate and would not accurately reflect quality of learning and 14-13 achievement for the district or campus;
(a-4)AANotwithstanding any other law and except as provided by Subsection (a-6), the commissioner may assign a school district or campus an overall performance rating of "Not Rated" if the commissioner determines that the assignment of a performance rating of A, B, C, D, or F would be inappropriate because:
14-14 (2)AAthe district or campus has experienced breaches or 14-15 other failures in data integrity to the extent that accurate 14-16 analysis of data regarding performance indicators is not possible;
(1)AAthe district or campus is located in an area that is subject to a declaration of a state of disaster under Chapter 418, Government Code, and due to the disaster, performance indicators for the district or campus are difficult to measure or evaluate and would not accurately reflect quality of learning and achievement for the district or campus;
14-17 (3)AAthe number of students enrolled in the district or 14-18 campus is insufficient to accurately evaluate the performance of 14-19 the district or campus;
(2)AAthe district or campus has experienced breaches or other failures in data integrity to the extent that accurate analysis of data regarding performance indicators is not possible;
or 14-20 (4)AAfor other reasons outside the control of the 14-21 district or campus, the performance indicators would not accurately 14-22 reflect quality of learning and achievement for the district or 14-23 campus.
(3)AAthe number of students enrolled in the district or campus is insufficient to accurately evaluate the performance of the district or campus;
14-24 (a-5)AANotwithstanding any other law, an overall performance 14-25 rating of "Not Rated" is not included in calculating consecutive 14-26 school years of unacceptable performance ratings and is not 14-27 considered a break in consecutive school years of unacceptable 14-28 performance ratings for purposes of any provision of this code.
or (4)AAfor other reasons outside the control of the district or campus, the performance indicators would not accurately reflect quality of learning and achievement for the district or S.B.ANo.A9 campus.
Any 14-29 interventions or sanctions to which a school district or campus is 14-30 subject under Chapter 39A shall continue during a period in which 14-31 the district or campus is assigned an overall performance rating of 14-32 "Not Rated." 14-33 (a-6)AAThe commissioner may not assign an overall 14-34 performance rating of "Not Rated" to all school districts or all 14-35 campuses on a statewide basis.
(a-5) AANotwithstanding any other law, an overall performance rating of "Not Rated" is not included in calculating consecutive school years of unacceptable performance ratings and is not considered a break in consecutive school years of unacceptable performance ratings for purposes of any provision of this code.
14-36 (a-7)AAIf the agency makes changes to the assessment program 14-37 under Section 39.022 for assessment instruments administered under 14-38 this subchapter that require new standards for issuing performance 14-39 ratings under this section, the agency must conduct a performance 14-40 comparison analysis between the program as changed and the 14-41 preceding program to establish roughly comparable standards for 14-42 issuing performance ratings.
Any interventions or sanctions to which a school district or campus is subject under Chapter 39A shall continue during a period in which the district or campus is assigned an overall performance rating of "Not Rated." (a-6)AAThe commissioner may not assign an overall performance rating of "Not Rated" to all school districts or all campuses on a statewide basis.
14-43 (c)AAThe commissioner shall make the information under 14-44 Subsection (a-3) available as soon as reasonably possible in years 14-45 in which the standards are modified or recalibrated or in which a 14-46 new assessment instrument is offered.
(a-7)AAIf the agency makes changes to the assessment program under Section 39.022 for assessment instruments administered under this subchapter that require new standards for issuing performance ratings under this section, the agency must conduct a performance comparison analysis between the program as changed and the preceding program to establish roughly comparable standards for issuing performance ratings.
14-47 SECTIONA2.005.AASection 39.0541, Education Code, is amended 14-48 to read as follows:
(c)AAThe commissioner shall make the information under Subsection (a-3) available as soon as reasonably possible in years in which the standards are modified or recalibrated or in which a new assessment instrument is offered.

14-69 SECTIONA2.007.AASection 39.0544, Education Code, is amended S.B.ANo.A9 15-1 by adding Subsection (f) to read as follows:

15-65 (c)AANotwithstanding any other law, if the agency is 15-66 permanently enjoined from assigning performance ratings to a school 15-67 district, open-enrollment charter school, or district or school 15-68 campus for a school year, the agency shall consider the district, 15-69 school, or campus to have received a "Not Rated" rating for that S.B.ANo.A9 16-1 school year for purposes of:

(e)AAExcept as provided by Subsection (f), the agency shall impose an intervention or sanction described by Subsection (b)(2) or (c)(2) as required by law unless the intervention or sanction, as determined by the commissioner:
