The updated version of Bill S 119 changes the waiting period for retired South Carolina employees before they can return to work from 30 days to 90 days. Additionally, it removes the limit on how much a retired worker can earn without affecting their retirement benefits, which previously capped earnings at $10,000. These changes are significant because they give retirees more flexibility in returning to work while allowing them to earn additional income without losing their pension benefits. This could help address workforce shortages by encouraging more retirees to rejoin the workforce.

Be it enacted by the General Assembly of the State of South Carolina:
SECTION 1. Section 9-11-90(4) of the S.C.

If a retired member of the system returns to employment covered by the South Carolina Police Officers Retirement System or any other system provided in this title sooner than thirty ninety consecutive calendar days after retirement, the member's retirement allowance is suspended while the member remains employed by a participating employer of any of these systems.
If an employer fails to notify the system of the engagement of a retired member to perform services, the employer shall reimburse the system for all benefits wrongly paid to the retired member.
