DEFINITIONS As used in this Compact, and except as otherwise provided, the following definitions shall apply:

"Single State License" means a Social Work license issued by any State that authorizes practice only within the issuing 20250HB0554PN1619 - 5 - State and does not include Multistate Authorization to Practice in any Member State.

Upon receipt of an application for Multistate License, 20250HB0554PN1619 - 12 - the Home State Licensing Authority shall determine the applicant's eligibility for a Multistate License in accordance with Section 4 of this Compact.

The Rules of the Commission shall have the force of law in each Member State, provided however that where the Rules of the Commission conflict with the laws of the Member State that establish the Member State's laws, regulations, and applicable standards that govern the practice of Social Work as held by a court of competent jurisdiction, the Rules of the Commission shall be ineffective in that State to the extent of the 20250HB0554PN1619 - 30 - conflict.

The provisions of this Compact shall be severable and if any phrase, clause, sentence or provision of this Compact is 20250HB0554PN1619 - 39 - held by a court of competent jurisdiction to be contrary to the constitution of any Member State, a State seeking participation in the Compact, or of the United States, or the applicability thereof to any government, agency, person or circumstance is held to be unconstitutional by a court of competent jurisdiction, the validity of the remainder of this Compact and the applicability thereof to any other government, agency, person or circumstance shall not be affected thereby.
The provisions of this Compact shall be severable and if 20250HB0554PN2868 - 39 - any phrase, clause, sentence or provision of this Compact is held by a court of competent jurisdiction to be contrary to the constitution of any Member State, a State seeking participation in the Compact, or of the United States, or the applicability thereof to any government, agency, person or circumstance is held to be unconstitutional by a court of competent jurisdiction, the validity of the remainder of this Compact and the applicability thereof to any other government, agency, person or circumstance shall not be affected thereby.
Any laws, statutes, regulations, or other legal requirements in a Member State in conflict with the Compact are 20250HB0554PN1619 - 40 - superseded to the extent of the conflict.

(C) IMPLEMENTATION.--THE STATE BOARD OF SOCIAL WORKERS, <-- MARRIAGE AND FAMILY THERAPISTS AND PROFESSIONAL COUNSELORS SHALL HAVE THE FOLLOWING DUTIES:
(1) PROMULGATE TEMPORARY REGULATIONS NECESSARY TO IMPLEMENT THIS ACT UNDER 63 PA.C.S.
§ 3120 (RELATING TO TEMPORARY RULEMAKING AUTHORITY) WITHIN ONE YEAR OF THE EFFECTIVE DATE OF THIS PARAGRAPH.
(2) ACCEPT COMPACT PRIVILEGE APPLICATIONS AND ISSUE 20250HB0554PN2868 - 41 - COMPACT PRIVILEGES UNDER THIS ACT WITHIN ONE YEAR OF THE EFFECTIVE DATE OF THIS PARAGRAPH.
The compact administrator who represents this State, as provided for in the Interstate Compact, shall not be entitled to any additional compensation for the compact administrator's duties and responsibilities as compact administrator but shall be entitled to reimbursement for reasonable expenses actually incurred in connection with the compact administrator's duties and responsibilities as compact administrator in the same manner as for expenses incurred in connection with other duties and 20250HB0554PN1619 - 41 - responsibilities of the compact administrator's office or employment.
The compact administrator who represents this State, as provided for in the Interstate Compact, shall not be entitled to any additional compensation for the compact administrator's duties and responsibilities as compact administrator but shall be entitled to reimbursement for reasonable expenses actually incurred in connection with the compact administrator's duties and responsibilities as compact administrator in the same manner as for expenses incurred in connection with other duties and responsibilities of the compact administrator's office or employment.
