Rules and Operations of the Senate March 26, 2025 A BILL TO BE ENTITLED AN ACT ESTABLISHING THE SAFE PARKS AND PUBLIC SPACES ACT.
It is the intention of the General Assembly to protect the peopleoftheState ofNorth Carolinain publicspaces andandrights-of-waybyenactingaprohibition rights-of-wayby enacting aprohibition on unauthorized camping in public spaces.
– The act of sleeping upon, occupying, or otherwise using as a substitute for regular shelter, any public property or right-of-way as evidenced by, but not limited to, the erection of a tent or other temporary shelter,thepresenceofbeddingshelter,thepresenceofbeddingorpillows, orpillows, orthestorageofpersonal property.
– It shall beunlawfulfor anypersonto intentionallyorknowinglyintentionallyorknowinglyengage engage in public camping in any location that is not designated as a campsite by the State or a county, city, or other political subdivision of the State.
This subsection does not applyapplyto to any *DRS15301-LM-96B**S724-v-1* General Assembly Of North Carolina Session 2025 property designated as a temporary site for unsheltered homeless encampments.
(2) The applicant has provided the countycountyor ormunicipalitywith municipality with five business days to cure the alleged violation.
