(c) A Code-enforcement official holding office as of the date specified in this subsection for the county or municipality by which he is employed, shall not be required to possess a standard certificate as a condition of tenure or continued employment but shall be required to Page 20 House Bill 661-First Edition General Assembly Of North Carolina Session 2025 complete such in-service training as may be prescribed by the Board.
The standard certificate shall authorize the person to practice as a qualified Code House Bill 661-Second Edition Page 21 General Assembly Of North Carolina Session 2025 enforcement official in a particular type of position at the level determined by the Board, based on the type of license or registration held in any profession specified above.

The person with whom the Board contracts may charge applicants a reasonable fee for the costs associated with the development and administration of the examinations, for course development related to the examinations, for review of the applicant's examinations, and for other related House Bill 661-First Edition Page 23 General Assembly Of North Carolina Session 2025 services.
The review shall be completed without undue delay, and Page 24 House Bill 661-Second Edition General Assembly Of North Carolina Session 2025 the applicant shall be notified promptly in writing as to the outcome of the review.
Page 24 House Bill 661-First Edition General Assembly Of North Carolina Session 2025 On and after July 1, 1979, it It shall be unlawful for any person to represent himself misrepresent themselves as a qualified Code-enforcement official who does not hold holder of a currently valid certificate of qualification issued by the Board.
(a) TheDivision ofEngineeringand BuildingCodes in thetheDepartment Department of InsuranceshallInsurance shall provide clerical and other staff services required by the Board, and shall administer and enforce all provisions of this Article and all rules promulgated pursuant to this Article, subject to the direction of the Board, except as delegated by this Article to local units of government, other State agencies, corporations, or individuals.

– The claimant shall accept a general contractor's offer, if any, in writing within 10 days of receipt of the offer pursuant to subsection (c)ofthis(c) of this section.
If a claimant files an action in court before first complying with the requirements of this Article, on motion of a party to the action, the court shall stay the action for 120 days and such additional time that is necessary for compliance with the requirements of this Article.Article." SECTION 5.1.(b) This section becomes effective October 1, 2025, and applies to actions commenced on or after that date.

Any statute of limitations applicable to a right of action of the claimant under this Article is tolled until the latter of the following events occur:
(i) the claimant denies a general contractor's offer, in writing, pursuant to G.S.
87-152(d), (ii) the general contractor denies the claimant's claim, (iii) the repair of the defect is completed, or (iv) either party determines that the general contractor cannot or will not repair the defect and provides written notice to the other party of the same." SECTION 5.1.(b) This section becomes effective October 1, 2025, and applies to actions commenced on or after that date.

MISCELLANEOUS 3 MODIFY PUBLIC POOL LAWS TO CLARIFY PRIVATE POOL EXCLUSION AND TO EXEMPT PUBLIC COLD BATHS AND FLOTATION/SENSORY DEPRIVATION SYSTEMS SECTION 6.1.(a) G.S.
As used in this Article, an Page 30 House Bill 661-First Edition General Assembly Of North Carolina Session 2025 "artificial swimming lagoon" means any body of water used for recreational purposes with more than20,000 square feet of surface area, an artificial liner,and amethod of disinfectantthat results in adisinfectant residual in theswimming zonethat is protective of thepublichealth.
Contains chilled water that is (i) maintained at a temperature lower than 60 degrees Fahrenheit, (ii) no more than 180 gallons in volume, House Bill 661-Second Edition Page 31 General Assembly Of North Carolina Session 2025 and (iii) at a depth that allows the bather to maintain the bather's head above the water while in a seated position.
(4) Floatation or sensory deprivation systems certified by the National Sanitation Foundation to meet the most current version of Standard 50 of the National Sanitation Foundation/American National Standards Institute.
