March 11, 2025 A BILL TO BE ENTITLED AN ACT TO PROVIDE THAT CONTRACTS FOR CONSTRUCTION OF WATER AND SEWAGE SYSTEMS OR FACILITIES MAY BE AWARDED WHEN AT LEAST TWO COMPETITIVE BIDS HAVE BEEN RECEIVED.
Housing and Development, if favorable, State and Local Government, if favorable, Rules, Calendar, and Operations of the House March 11, 2025 A BILL TO BE ENTITLED AN ACT TO EXEMPT THE TOWNS OF HOLLY SPRINGS AND FUQUAY-VARINA FROM THE COMPETITIVE BIDDING REQUIREMENTS FOR PUBLIC INFRASTRUCTURE PROJECTS.

The Town of Holly Springs and the Town of Fuquay-Varina may contract for the construction of public infrastructure projects without being subject to Article 8 of Chapter 143 of the General Statutes provided that:
143-132 is amended by adding a new subsection to read:
(1) The Town Council adopts a resolution approving the exemption of a public infrastructure project from the competitive bidding requirements of Article 8 of Chapter 143 of the General Statutes.
"(a1) Notwithstanding the provisions of subsection (a) of this section, no contract to which G.S.
(2) The Town Council conducts an annual independent audit of all contracts for construction work that would otherwise be subject to the competitive bidding requirements of Article 9 of Chapter 143 of the General Statutes.
143-129 applies for construction of water systems or facilities, or sewage disposal systems or facilities, shall be awarded by any board or governing board of the State, or any political subdivision of the State, unless two competitive bids have been received from reputable and qualified contractors regularly engaged in their respective lines of endeavor.
(3) The Town Council makes public any contracts awarded pursuant to this act.
Except as provided in this subsection, all requirements of subsection (a) of this section apply to the receipt of bids and theawardofconstruction contracts.
(4) The Town Council, after awarding the contract pursuant to this act, prepares, places in the public files, and makes available to the public a document setting forth the reasons for using the authority granted by this act to award the contract.
Forpurposes ofthis subsection, thefollowingdefinitions shall apply:
SECTION 2.
(1) Sewage disposal systems or facilities.
– Sewage disposal systems or facilities, including all plants, works, instrumentalities, and properties used or useful in the collection, treatment, purification, or disposal of sewage.
(2) Water systems or facilities.
– Water systems or facilities, including all plants, works, instrumentalities, and properties used or useful in obtaining, conserving, treating, and distributing water for domestic or industrial use, irrigation, sanitation, fire protection, or any other public or private use." SECTION 2.
