This bill is no longer active — its legislative session has ended, so there is no live prognosis. It would have to be reintroduced in the current session to move again.
Summary
Amends the Tobacco Product Manufacturer's Escrow Act. Provides that a holding of unconstitutionality or the repeal of subdivision (2)(B) of the escrow provisions provided under Section 15 of the Act will not affect, impair, or invalidate any other portion of that Section (now, this severability provision only applies to subdivision (2)(B)(ii)). Effective immediately.

The amendment to SB 1658 eliminates a specific provision regarding the effects of unconstitutionality related to certain escrow provisions, broadening the application of the severability clause. Previously, this clause only applied to a specific part, but now it ensures that if any part of Section 15 is found unconstitutional, the rest of the section remains valid and enforceable. This change matters because it strengthens the overall stability of Section 15, protecting it from being entirely invalidated due to one problematic provision.
