(AGE) AN ACT ESTABLISHING MAXIMUM RATES FOR TEMPORARY NURSING SERVICES PROVIDED BY A TEMPORARY NURSING SERVICES AGENCY TO A NURSING HOME FACILITY.

AN ACT ESTABLISHING A TASK FORCE TO STUDY TEMPORARY NURSING SERVICES PROVIDED TO NURSING HOME FACILITIES.
Section 19a-118 of the general statutes is repealed and the following is substituted in lieu thereof (Effective July 1, 2024):
(Effective from passage) (a) There is established a task force to study temporary nursing services provided to nursing home facilities in the state.
(a) As used in this section and sections 19a-118a and 19a-118b, (1) "health care facility" means a hospital, nursing home facility or residential care home as those terms are defined in section 19a-490;
Such study shall include, but need not be limited to, an examination of (1) the prevalence of the use of temporary nursing services agencies by nursing home facilities over the preceding four- year period, including, but not limited to, an analysis of any change in the prevalence of such use;
(2) "nursing personnel" means an advanced practice registered nurse, a licensed practical nurse or a registered nurse licensed or issued a temporary permit to practice pursuant to chapter 378, or a nurse's aide registered pursuant to chapter 378a;
(2) the cost of temporary nursing services to nursing home facilities, including, but not limited to, the average cost of a temporary nurse to a nursing home facility and the average wage paid to a temporary nurse by a temporary nursing services agency;
(3) "temporary nursing services" means services provided to a health care facility on a per diem or other temporary basis;
and (3) the feasibility of establishing a maximum rate for temporary nursing services provided by a temporary nursing services agency to a nursing home facility, including, but not limited to, an analysis of any unintended consequences that may occur due to the establishment of sSB246 / File No.
and (4) "temporary nursing services agency" means any person, firm, corporation, limited liability company, partnership or association that is engaged for hire in the business of providing temporary nursing services to a health care facility but does not include LCO No.

(b) Not later than October 1, 2022, the Commissioner of Public Health shall develop a system for a temporary nursing services agency that provides services in the state to register annually with the Department of Public Health.
(b) The task force shall consist of the following members:
The commissioner may assess an annual registration fee of not more than seven hundred fifty dollars.
(1) Two appointed by the speaker of the House of Representatives;
(c) Not later than January 1, 2023, no temporary nursing services agency shall provide temporary nursing services in the state unless it is registered pursuant to subsection (b) of this section.
(2) Two appointed by the president pro tempore of the Senate;
(d) The Commissioner of Public Health shall establish requirements for a temporary nursing services agency, including, but not limited to, minimum qualifications for nursing personnel provided by such agency.
(3) One appointed by the majority leader of the House of Representatives;
(e) Beginning not later than July 1, 2023, each temporary nursing services agency shall submit, in a form and manner prescribed by the Commissioner of Public Health, in consultation with the Commissioner of Social Services, an annual cost report for the previous calendar year.
(4) One appointed by the majority leader of the Senate;
Such report shall be filed with the Commissioner of Public Health and may include, but shall not be limited to, (1) itemized revenues and costs for each such agency;
(5) One appointed by the minority leader of the House of Representatives;
(2) average number of nursing personnel employed by such agency;
(6) One appointed by the minority leader of the Senate;
(3) average fees charged by such agency by type of nursing personnel and type of health care facility;
and (7) The Commissioner of Public Health, or the commissioner's designee.
(4) the states of the permanent residences of nursing personnel supplied by the agency tohealth carefacilitiesinthestate, aggregatedbytypeofnursing personnel;
(c) Any member of the task force appointed under subdivision (1), (2), (3), (4), (5) or (6) of subsection (b) of this section may be a member of the General Assembly.
and (5) any other information prescribed by the Commissioner of Public Health.
(d) All initial appointments to the task force shall be made not later thanthirty daysafter theeffective date ofthis section.Any vacancy shall be filled by the appointing authority.
Each such agency shall make available records, books, reports and other data relating to its operation at the request of the Commissioner of Public Health, or the commissioner's designee.
(e)The speaker oftheHouse ofRepresentativesandthepresident pro tempore of the Senate shall select the chairpersons of the task force from among the members of the task force.
Records provided by a temporary nursing services agency pursuant to this subsection shall not be considered public records subject to disclosure pursuant to section 1-210.
Such chairpersons shall schedule thefirst meeting ofthe task force, whichshall beheld not later thansixty days after the effective date of this section.

(f) The administrative staff of the joint standing committee of the General Assembly having cognizance of matters relating to aging shall serve as administrative staff of the task force.

(g) Not later than January 1, 2025, the task force shall submit a report sSB246 / File No.
246 (f) For new temporary nursing services contracts entered into on and after July 1, 2024, a temporary nursing services agency's rate for the provision of temporary nursing services to a nursing home facility shall not exceed two hundred per cent of the median hourly wage for nursing personnel by type of nursing personnel in the state, as published in the most recent State Occupational Employment and Wage Estimates for the state by the United States Department of Labor, Bureau of Labor Statistics.

Such rate shall include all charges for administrative fees, contract fees and other special charges.
118 on its findings and recommendations to the joint standing committees of the General Assembly having cognizance of matters relating to aging and public health, in accordance with the provisions of section 11-4a of the general statutes.
[(f)] (g) The Commissioner of Public Health may adopt regulations in accordance with chapter 54 to implement the provisions of this section.
The task force shall terminate on the date that it submits such report or January 1, 2025, whichever is later.
The commissioner may adopt policies and procedures to implement the provisions of this section in advance of adopting regulations, provided notice of intent to adopt such regulations is posted on the eRegulations System not later than twenty days after adoption of such policies and procedures.
