AN ACT REQUIRING THE LICENSURE OF LACTATION CONSULTANTS.
(NEW) (Effective OctoberJuly 1, 2027)2026) As used in this section and sections 2 to 4, inclusive, of this act:
(1) "Lactation consultant" means a person who holds and maintains certification in good standing as an international board certified lactation consultant with the International Board of Lactation Consultant Examiners;Examiners and is licensed pursuant to section 3 of this act;
(A) Taking maternal, child and feeding histories;

(B) Performing clinical assessments related to breastfeeding and human lactation through the systematic collection of subjective and objective information;
(NEW) (Effective OctoberJuly 1, 2027)2026) (a) No person may practice lactation consulting, for compensation, unless licensed pursuant to section 3 of this act.
(b) No person mayshall use(1) hold himself or herself out to the public as being licensed as a lactation consultant, (2) use, in connection with such person's name or business, the title "licensed lactation consultant" or "lactation consultant" or the designation "IBCLC" or "L.C.", or (3) make use of any title, words, letters, abbreviations or insignia that may reasonably be confused withlicensurewith licensure as alactationa consultantlactation consultant, unless such person is licensed pursuant to section 3 of this act.
(c) The provisions of this section shall not apply to a person who (1) providesis lactationlicensed consultingor whilecertified actingby within the scopeDepartment of practicePublic ofHealth thepursuant person'sto licensetitle and20 training,of provided the persongeneral doesstatutes not hold himself or herselfby out to the publicDepartment as a lactation consultant, (2) is a student enrolled in a lactation consulting educational program or a graduate nursing or medical education program in lactation consulting and lactation consulting is an integral part of theConsumer student's course of sHB5318 / File No.

410622 studyProtectionpursuanttochapter400jofthegeneralstatutesandproviding andlactation suchconsulting studentwhile isacting performingwithin suchthe consultingscope underof practice of the directperson's supervisionlicense ofor acertification, licensedprovided lactationthe consultant,person physiciandoes not refer to himself or otherherself healthby carethe providerterm or"lactation educatorconsultant", who(2) providesis a student enrolled in a lactation consulting educational program or an accredited education inprogram lactationthe counselingcompletion withinof which is required for licensure or certification by the scopeDepartment of practicePublic Health pursuant to title 20 of the provider'sgeneral licensestatutes or by the Department of Consumer Protection pursuant to chapter 400j of the general statutes, lactation consulting is a part of the student's course of study and training,the student is performing such consulting under appropriate program supervision, provided the student does not refer to himself or herself by the term "lactation consultant", (3) provides lactation consultingeducation and support through the federal Special Supplemental Food Program for Women, Infants and Children, administered pursuant to section 19a-59c of the general statutes, or any other federally funded nutrition assistance program administered in the state, to participants in such program while acting within the scope of the person's professionjob description and training, provided the person does not holdrefer to himself or herself outby to the publicterm as"lactation aconsultant", lactation consultant, or (4) providesis lactationcertified consulting as a certified community health worker, asasdefined defined in section 20-195ttt of the general statutes, and providing lactation support to a HUSKY Health program member, provided the community health worker does not refer to himself or herself by the term "lactation consultant", (5) provides education, social support, peer support, peer counseling or nonclinical services relating to lactation and feeding, provided the person does not holdrefer to himself or herself outby the term "lactation consultant", (6) is a doula or midwife and providing services within the doula's or midwife's scope of practice and for which the doula or midwife is trained, provided the doula or midwife does not refer to himself or herself by the term "lactation consultant", or (7) is a public ashealth professional and engaging in outreach, engagement, education, coaching, informal counseling, social support, advocacy, care coordination or research related to social determinants of health or a lactationbasic consultant.screening or assessment of any risk associated with social determinants of health, provided the professional does not refer to sHB5318 / File No.

(NEW) (Effective OctoberJuly 1, 2027)2026) (a) The Commissioner of Public Health shall grant a license as a lactation consultant to any applicant who furnishes evidence satisfactory to the commissioner that such applicant has earned a certification oras credentialan international board certified lactation consultant from the InternationalBoardofLactationConsultantExaminers,oranysuccessorInternational Board of Lactation Consultant Examiners, or any successor of said board.
Each licensed lactation consultant applying for license renewal shall furnish evidence satisfactory to the commissioner of havinghavingacurrentcertificationasaninternationalboardcertifiedlactation aconsultant current certification or credential with the International Board of Lactation Consultant Examiners, or any successor of said board, and having obtained continuing education units for such certification or credential as required by said board.
(NEW) (Effective OctoberJuly 1, 2027)2026) The Commissioner of Public Health may deny an application of an individual or take any sHB5318disciplinary /action Fileset No.forth in section 19a-17 of the general statutes against a lactation consultant for any of the following reasons:

The licensure application fee is $200, and licenses may be renewed every two years for $100.

July 1, 2026 Lactation Consulting Definition (§ 1) Under the bill, “lactation consulting” is helping families with lactation and feeding by clinically applying scientific principles and multidisciplinary evidence for evaluation, problem identification, treatment, education, and consultation, including the following services:
Licensure Requirement and Exemptions (§ 2) The bill generally prohibits anyone without a lactation consultant license fromfrom: (1) practicing lactation consulting for compensation or (2) using the title “lactation consultant,” “L.C.”, or any title, words, letters, abbreviations, or insignia that may reasonably be confused with this credential.
These restrictions do not prevent people without this license from providing lactation consulting under the following conditions, as long as they do not hold themselves out to the public as lactation consultants:
