The bill amends existing laws to include provisions for electronic identification scanners in mitigating penalties for alcohol-related offenses and establishes reporting requirements for law enforcement.
-
561.706
The division shall consider qualification as a responsible vendor in mitigation of administrative penalties for an employee’s illegal sale or service of an alcoholic beverage to a person who is not of lawful drinking age and if the vendor has administered the applicable courses for controlled substances, for an employee’s engaging in the illegal sale, use of, or trafficking in controlled substances.→ The division shall consider the vendor’s use of an electronic identification scanner to check the driver license or identification card of a person and verify his or her age in mitigation of administrative penalties for an employee’s illegal sale or service of an alcoholic beverage to a person who is not of lawful drinking age. This change requires the consideration of using electronic identification scanners as a factor for reducing penalties related to underage alcohol sales.
-
562.11
In addition to any other penalty authorized under the Beverage Law, the division may require a vendor found to have violated paragraph (1)(a) or paragraph (1)(b) to use an electronic identification scanner to check the driver license or identification card of a person and verify his or her age.
This allows the division to mandate electronic identification scanner usage for vendors who violate laws relating to serving alcohol to minors.
-
562.114
State and local law enforcement agencies shall refer to the division all relevant reports of investigations and arrests concerning the driver of a vehicle involved in a crash on public or private property while driving under the influence of alcoholic beverages which contributed in whole or in part to serious bodily injury or the death of a person.
This establishes a requirement for law enforcement to report certain DUI-related incidents to the division.
