(a) Upon a first conviction, by imprisonment for up to 90 days or by a fine of $500, or by both such fine and imprisonment.

A(a) personUpon convicted of a secondfirst orconviction, subsequentby violationimprisonment offor thisup sectionto thata occursperiod withinof 5not yearsmore afterthan the90 datedays ofor aby prior conviction for a violationfine of thisnot sectionless shallthan have$25 hisnor ormore herthan driving$500, privilegeor revokedby forboth atsuch leastfine 180and daysimprisonment. but no more than 1 year.
(b) On a second or subsequent conviction, by imprisonment for up to not more than 6 months or by a fine of not less than $5,000 $50 nor more than $1,000, or by both such fine and imprisonment.
In addition, the court shall revoke the person's driving privilege for 1 year.
