733 The following Fiscal Impact Statement and Bill Analysis are prepared for the benefit of the members of the General Assembly, solely for purposes of information, summarization and explanation and do not represent the intent of the General Assembly or either chamber thereof for any purpose.
In general, fiscal impacts are based upon a variety of informational sources, including the analyst’s professional knowledge.
Whenever applicable, agency data is consulted as part of the analysis, however final products do not necessarily reflect an assessment from any specific department.

GF - See Below See Below See Below See Below Note:
GF=General Fund Municipal Impact:
None Explanation The bill establishes a non-lapsing charter school approval grant account to fund new charter schools, beginning in FY 24.
Any impact will depend on the amount of funding available for deposit into the account.
The bill specifies that any funding in the Charter Schools account (which provides operating grants to charter schools) that would otherwise lapse at the end of any fiscal year shall be deposited into the charter school approval grant account, beginning in FY 23.
As the account is currently projected to lapse $2.5 million, the bill would result in that funding not lapsing, and instead being deposited into the charter school approval grant account.
The bill also allows the account to accept appropriations, but does not appropriate any funding.
It requires the State Department of Education (SDE) to provide funding from the account to any charter school that received an initial certificate of approval between March 1, 2023 and July 1, 2023, or any charter schoolthat isapprovedafter July 1,2023.
The funding isfor each new charter school in the fiscal year immediately following SDE approval.
The bill additionally caps SDE approval of new state charter sSB1096 / File No.

733 schools to two per fiscal year, beginning in FY 24, which limits the account's expenditures in FY 25 and beyond.
The Out Years The annualized ongoing fiscal impact identified above would continue into the future subject to the number of charter schools approved by SDE in a fiscal year and any funds in the charter school approval grant account.

733 OLR Bill Analysis sSB 1096 AN ACT CONCERNING THE CHARTER SCHOOL APPROVAL PROCESS.
SUMMARY Under current law, the State Board of Education (SBE) may grant “initial certificates of approval” for charters for local and state charter schools (see BACKGROUND).
However, the new school’s initial certificate only takes effect as a full charter when the legislature appropriates funds to the State Department of Education (SDE) for its operations.
The school receives its charter as of July 1 in the fiscal year for which the funds are appropriated.
AsofJuly 1, 2023, thisbillallowsSBEto grantfullchartersratherthan initial certificates of approval.
Additionally, it creates the “charter school approval grant account” within the General Fund to give initial funding to state and local charter schools that have been granted a new charter.
The bill requires SDE to provide these funds in the fiscal year immediately following the one in which the charter was granted, instead of waiting for the legislature to appropriate the funds.
Relatedly, the bill eliminates the requirement that SBE submit a copy of the initial certificate of approval and a summary of comments from the required public hearing to the Appropriations and Education committees.
Additionally, the bill prohibits SBE from approving more than two new state charter schools per fiscal year beginning in FY 24.
It also makes many conforming changes and removes obsolete language in current law about SBE’s approval of new state charter sSB1096 / File No.
733 17 sSB1096 File No.
733 school applications before July 1, 2015.
EFFECTIVE DATE:
July 1, 2023, except the provisions creating the charter school approval account and directing certain funds to the account are effective upon passage.
CHARTER SCHOOL APPROVAL GRANT ACCOUNT Under the bill, the charter school approval grant account must be a separate, nonlapsing account within the General Fund.
It must contain any funds that the law requires to be deposited into it, which under the bill includes any unexpended state funds appropriated for local and state charter schools’ per-pupil operating grants.
If unexpended at the end of the fiscal year, the funds will be deposited in the account and available for the following fiscal year rather than lapse into the General Fund.
The education commissioner must expend account funds for the initial funding for a local or state charter school to which SBE has granted (1) an initial certificate of approval for a charter under current lawonor after March1, 2023,but before July 1,2023, or (2)anew charter on and after July 1, 2023 (under the bill’s provisions).
BACKGROUND Local and State Charter Schools Local charter schools are part of the public school district where they are located (currently there is only one such school in the state).
State charter schools are managed by private boards that are not affiliated with or under the control of any public board of education (CGS § 10- 66bb(c), (e), and (f)).
Local charters receive funding through the host school district and studentsat these schoolscount towardsthehost district’seducationcost sharing (ECS) grant.
State charter school students do not count toward a district’s ECS grant, but the state has a separate per-student charter school grant (CGS § 10-66ee).
