Thus, the public availability of such information has a chilling effect on the establishment of new banks in this state.
An exemption from public records is necessary to ensure the office’s ability to administer its regulatory duties while preventing unwarranted damage to an applicant’s good name or impairment of its safety and soundness, as well as the safety and soundness of the financial system of this state.
Further, the public availability of the books and financial records of a current or proposed financial institution in this state presents an unnecessary risk of harm to the business operations of such institutions.
Release of any portion of an application that reveals an individual’s personal financial information, government identity verification documents, or home address could cause unwarranted damage to the good names or reputation of those individuals or jeopardize their safety.
Finally, the public availability of a proposed bank’s business plan may cause competitive harm to such bank’s future business operations and presents an unfair competitive advantage for existing financial institutions that are not required to release such information.
