Amend KRS 262.850 to decrease the minimum number of acres to qualify as an agricultural district from 250 acres to 50 acres; add cities that are within one mile of the agricultural district to the list of entities to be notified of the proposal, approval, and withdrawal of property from, an agricultural district; allow a district board of supervisors of supervisors to consider possible dissolution of an agricultural district if an owner's withdrawal of property results in the remaining land no longer qualifying as agricultural land.

The removal of the property from the agricultural district shall be effective immediately upon the district board of supervisors' receipt of the written notification, at which time the district board of supervisors shall remove the property from the agricultural district and shall immediately provide written notice of the changed boundaries to the those Page 3 of 5 HB041810.100 - 1850 - XXXX 2/20/2024 5:04 PM GA UNOFFICIAL COPY 24 RS HB 418/GA entities listed in subsection (9) of this section.
The removal of the property from the agricultural district shall be effective immediately upon the district board of supervisors' receipt of the written notification, at which time the district board of supervisors shall remove the property from the agricultural district and shall immediately provide written notice of the changed boundaries to the those entities listed in subsection (9) of this section.
The local district board of supervisors may consider a dissolution of the agricultural district if the withdrawal results in the remaining Page 4 of 5 HB041810.100 - 1850 - XXXX 2/20/2024 5:04 PM GA UNOFFICIAL COPY 24 RS HB 418/GA property within the agricultural district no longer meeting the definition of agricultural land as defined in KRS 132.010.
The local district board of supervisors may consider a dissolution of the agricultural district if the withdrawal results in the remaining property within the agricultural district no longer meeting the definition of agricultural land as defined in KRS 132.010.
(b) The board shall also notify the local property valuation administrator whenever a farm is released or withdrawn from an agricultural district.
