The updated version of SB 90 adds a requirement for law enforcement officers to inform individuals stopped for texting while driving about their right to decline a search of their wireless communications device. This change is important as it aims to protect citizens' privacy rights during traffic stops, ensuring they are aware they do not have to consent to a search unless they choose to do so. Additionally, while the proceeds from fines for texting while driving will still go to the Emergency Medical Services Trust Fund, the details around enforcement procedures have been clarified.
