Subsection (4) of section 83.51, Florida Statutes, is renumbered as subsection (5), and a new subsection (4) is added to that section, to read:
Subsection (6) is added to section 509.211, Florida Statutes, to read:
83.51 Landlord's obligation to maintain premises.— (4) If a dwelling unit has a residential swimming pool or the premises have access to a standing body of water within 150 yards of the dwelling unit, the landlord must ensure that the dwelling unit is equipped with at least one of the safety features required under s.
509.211 Safety regulations.— (6)(a) If a public lodging establishment licensed as a vacation rental has, within 150 feet of the rental unit, a water body or swimming pool, the licensee must ensure that:
515.27(1) at all times when the dwelling unit is being rented.

A landlord who violates this subsection commits a misdemeanor of the second degree, punishable as provided in s.
All doors and windows that provide direct access to the exterior of the rental unit or to an indoor swimming pool within the rental unit are equipped with an exit alarm that has a minimum sound pressure rating of 85 dB A at 10 feet;

All doors that provide direct access to the exterior of the rental unit or to an indoor swimming pool within the rental unit are equipped with a self-closing, self-latching device with a release mechanism placed at least 54 inches above the floor.
Section 2.
Subsection (3) is added to section 515.27, Florida Statutes, to read:
515.27 Residential swimming pool safety feature options;
hb79-00 F L O R I D A H O U S E O F R E P R E S E N T A T I V E S HB 79 2026 penalties.— (3) A person who offers his or her residential property for rent and such property has a residential swimming pool or access to a standing body of water within 150 yards of the property must ensure that the property is equipped with at least one of the safety features required by subsection (1) at all times when the property is being rented.
hb79-01-c1 F L O R I D A H O U S E O F R E P R E S E N T A T I V E S CS/HB 79 2026 (b) A licensee who violates paragraph (a) is liable to a guest of the public lodging establishment for such guest's actual damages incurred due to the violation, unless the violation is due to the removal or modification of any safety feature required under paragraph (a) by or at the request of the guest, a member of the guest's family, or a person on the premises of the rental unit with the guest's consent.
A person who violates this subsection commits a misdemeanor of the second degree, punishable as provided in s.
