The amendment to HB 5370 adds a requirement that for all pending or approved change orders or directives to perform extra work totaling twenty-five thousand dollars or more, the minimum allowable rate of overhead and profit to be paid to any contractor or subcontractor shall be not less than fifteen percent of the total value of such extra work. This provision applies to contracts advertised by the Department of Administrative Services, other state agencies (except the state Department of Transportation), municipalities, or municipal agencies. This change clarifies the conditions under which the minimum rate of overhead and profit applies, ensuring consistency across different types of contracts.
