(b) A surgical operation is not a violation of subsection (a) of this section if such operation is (1) necessary to the health of the person on whom it is performed, and is performed by a physician licensed pursuant to chapter 370;

or (2) performed on a person in labor or who has just given birth by a physician licensed pursuant to chapter 370, a nurse-midwife licensed pursuant to chapter 377 or a person in training to become such a physician or nurse-midwife.
