Summary

Under existing law, the division of veterans affairs (division) within the department of military and veterans affairs operates a veterans resource information clearinghouse (clearinghouse) to provide information concerning support, services, and other assistance available to veterans and their families. The bill requires the division to create and maintain an online portal to assist veterans with accessing information provided through the clearinghouse, allow users to maintain a personalized health record in the portal, and offer secure care coordination and personalized care tools that help veterans be more engaged in their health. The division is permitted to enter into an agreement with a third party to create and maintain the online portal or, if the third party maintains an existing, similar portal, to expand and maintain that existing portal.(Note: This summary applies to this bill as introduced.)

(IV) PROVIDE USERS WITH INFORMATIONONVETERANSSERVICES PROVIDED BY ALL STATE AGENCIES AND INSTITUTIONS OF HIGHER EDUCATION ;AND (V) COMPLY WITH THE FEDERAL "H EALTH INSURANCE -2- 1219 PORTABILITY AND ACCOUNTABILITY ACT OF 1996",AS AMENDED , 42 U.S.C.SEC .
(c) THE DIVISION MAY CONTRACT WITH A THIRD PARTY TO :
1320dTO 1320d-9,AND WITH ALL APPLICABLE STATE AND FEDERAL DATA PRIVACY LAWS .
(I) CREATE AND MAINTAIN THE PORTAL ;OR (II) I THE THIRD PARTY MAINTAINS AN ONLINE PORTAL THAT IS SUBSTANTIALLYSIMILARTOTHE PORTALDESCRIBEDINTHISSUBSECTION (4),TO EXPAND AND MAINTAIN THE EXISTING PORTAL SO THAT IT SATISFIES THE REQUIREMENTS OF THIS SUBSECTION (4).
(b) I ORDER TO ENSURE ACCESS FOR ALL OF COLORADO S VETERANS , THE PORTAL MUST COMPLY WITH ANY APPLICABLE REQUIREMENTSOFTHEFEDERAL "A MERICANSWITH D ISABILITIEACTOF 1990", 42 U.S.C.SEC.
12101 ET SEQ.AS AMENDED ,AND THE STATE ACCESSIBILITY STANDARDS DESCRIBED IN SECTIO24-85-103 (1).
(c) THE DIVISION MAY CONTRACT WITH A THIRD PARTY :O (I) CREATE AND MAINTAIN THE PORTAL;OR (II) I THE THIRD PARTY MAINTAINS AN ONLINE PORTAL THAT IS SUBSTANTIALLYSIMILARTOTHE PORTALDESCRIBEDINTHISSUBSECTION (4),TO EXPAND AND MAINTAIN THE EXISTING PORTAL SO THAT IT SATISFIES THE REQUIREMENTS OF THIS SUBSECTIO(4).
(d) F THE DIVISION ELECTS TO ENTER INTO A CONTRACT WITH A THIRD PARTY PURSUANT TO SUBSECTION (4)(c)OF THIS SECTIO, THE THIRD PARTY SHALL:
(I) PROVIDE THE DIVISION WITH REGULAR UPDATES ABOUT THE INFORMATION CONTAINED IN THE PORTAL SERVICE DIRECTORY AND CONSISTENT PLATFORM METRICS ,AT A FREQUENCY DETERMINED BY THE DIVISION;AND (II) ELIVERTOTHEDIVISIONANANNUALREPORTONTHEPORTAL THAT THE DEPARTMENT OF MILITARY AND VETERANS AFFAIRS MAY INCLUDE IN ITS ANNUAL PRESENTATION TO THE COMMITTEES OF REFERENCE PURSUANT TO SECTION 2-7-203.
(e) (I) N CARRYING OUT ITS DUTIES PURSUANT TO THIS SUBSECTION (4)THE DIVISION SHALLCOMPLYWITHTHE "PROCUREMENT -3- 1219 C ODE",ARTICLES 101TO 112 OF TITL24.
(II) THE DIVISION SHALL CONSULT WITH THE OFFICE OF INFORMATION TECHNOLOGY ,CREATED IN SECTION 24-37.5-103ON THE SELECTION OF TECHNOLOGY FOR THE PURPOSES OF THIS SUBSECTION(4) AND , IF APPLICABL, SELECTION OF A THIRD PARTY PURSUANT TO SUBSECTION (4)(c)OF THIS SECTIO.
(f) HEDIVISIONMAYSEEK ,ACCEPT ,ANDEXPENDGIFTS ,GRANTS , OR DONATIONS FROM PRIVATE OR PUBLIC SOURCES FOR THE PURPOSES OF THIS SUBSECTION(4).
on the day following the expiration of the ninety-dayperiodafterfinaladjournmentofthegeneralassembly;except that, if areferendumpetition is filed pursuant to section 1 (3) of article V of the state constitution against this act or an item, section, or part of this act within such period, then the act, item, section, or part will not take effect unless approved by the people at the general election to be held in November 2022 and, in such case, will take effect on the date of the official declaration of the vote thereon by the governor.
