"loan" means a contract between the authority and a qualified professional to finance the purchase of a home;

[NEW MATERIAL]MATERIAL ] PROFESSIONAL RECRUITMENT AND RETENTION HOUSING LOAN FOR SERVICE PROGRAM CREATED--LOAN APPLICANT ELIGIBILITY--QUALIFICATIONS.-- A.
The "professional recruitment and retention h housing loan for service program" is created within the g o t hr authority.
The authority may promulgate rules to carry out the g e i k provisions of the Professional Recruitment and Retention Act.
h r i s B.
The authority shall create an account for any h , t, money designated for the program.
Loans for the program shall e u g e b l e e h be provided from the account, and the account may consist of en td 17d i = = o h subaccounts as the authority deems necessary.

The authority may grant a loan to a qualified =r = 19 a l professional for the down payment or closing costs associated i a= e r 20t withe thew purchased ofm a homen ino Newprofessional Mexico in exchange for the adown tpayment mor mclosing 21costs qualifiedassociated professional practicing in the state for ten years at d rm e: 22 no less than three-fourths of full-time employment.

uApplications [shall (1)be documentationsubmitted thatto the qualifiedauthority .232706.1on -forms 3provided - professional earns a current annual income that is below one hundred fifty-one percent of the area median income in the county in which the home being purchased is located, adjusted for family size, as determined by the Unitedauthority States department of housing and urbanshall development;include:
(1) documentation that the qualified professional earns a current annual income that is HGEICº equal to or»HGEIC below one hundred HGEICºfifty-one»HGEIC HGEICºfifty»HGEIC percent of the area median income in the county in which the home being purchased is located, adjusted for family size, as determined by the United States department of housing and urban development;

if granted, the loan provided by the authority =d =m 19: a l shall be a lien on the property for ten years, unless the i a e r 20 qualified professional pays off the loan.

SECTION 5.

The authority may cancel a contract entered into g o t hr with a qualified professional for any reasonable cause deemed g e i k sufficient by the authority.

The authority may sue in its own name to enforce h , t, e u g a contract and may seek other remedies available at law or in e b l e e h equity.

A qualified professional who is provided a loan el t] 17b ,d i a º e and who moves out of state, does not work the required hours, wr li n= r t e w d 18m a n o loses or allows to lapse the license to practice or who =d =m 19: a l otherwise violates the loan contract within:

u(1) [the (2)first five to seven years of the loan shall .232706.1 - 5 - reimburse the authority for fiftythe percentfull amount of the loan at an interest rate of five and one-half percent using the proceeds from the sale of the property that was purchased using the loan;
(2) five to seven years of the loan shall reimburse the authority for fifty percent of the loan at an interest rate of five and one-half percent using the proceeds from the sale of the property that was purchased using the loan;

The authority shall provide by rule for loan u » r forgiveness due to extenuating circumstances that are not t h g e l i within the control of the loan recipient, such as serious h r i s illness or incapacitation.

APPROPRIATION.--Fiveb millionr dollars i a e rt 20º ($5,000,000)o is appropriated from the general fund to the a t mn m= 21.232706.1AIC departmentJanuary of26, finance and administration for expenditure in d r e 22 fiscal years 2026 and(2:00pm) 2027 to contract with the New Mexico c e s k 23m mortgagee finance- authority6 to- carrye outa then provisionse ofd ther e al nu b[ 24A Professionald RecruitmentSECTION and7. Retention Act.
AnyAPPROPRIATION.--Five unexpendedmillion udollars [($5,000,000) balanceis remainingappropriated atfrom the endgeneral fund to the department of finance and administration for expenditure in fiscal yearyears 2026 and 2027 shallto revertcontract .232706.1with -the 6New -Mexico mortgage finance authority to carry out the generalprovisions fund.of the Professional Recruitment and Retention Act.
