Summary
(1) Existing law, until January 1, 2013, requires the San Joaquin Valley Unified Air Pollution Control District (district) to develop and administer, in consultation with the State Air Resources Board, a voluntary program to remove high polluter vehicles within the district by exchanging high polluter vehicles in the district for donated vehicles, as provided. This bill would repeal these provisions, and instead require the district to administer, until January 1, 2014, a voluntary program to replace or retrofit high emitting schoolbuses in the San Joaquin Valley. By imposing duties on a local air district, the bill would impose a state-mandated local program. (2) The California Constitution requires the state to reimburse local agencies and school districts for certain costs mandated by the state. Statutory provisions establish procedures for making that reimbursement. This bill would provide that, if the Commission on State Mandates determines that the bill contains costs mandated by the state, reimbursement for those costs shall be made pursuant to these statutory provisions.
