In plain language
This bill increases user fees related to land surveying and recording instruments.
SB 938 revises the fees for recording instruments by increasing the charge collected by recorders of deeds. It also sets aside funds for land surveying and allows the Department of Agriculture to establish additional fees related to surveys.
What this means for you
- Consumers: Consumers involved in property transactions will pay increased fees for recording documents.
- Small Business: Small businesses engaging in land transactions may face higher recording fees.
Summary
SB 938 - Under the act, a user fee of six dollars, instead of four dollars as currently provided, shall be charged and collected by every recorder of deeds as a condition precedent to the recording of any instrument. Three dollars, instead of two dollars as currently provided, of such fee shall be retained by the recorder and deposited in the Recorder's Fund and not in county general revenue. A fee in the amount of two dollars, instead of one dollar as currently provided, shall be paid to the State Treasurer and credited to the "Missouri Land Survey Fund" for purposes of land surveying. The Department of Agriculture shall establish by rule the fees necessary to reflect the costs associated with the production or reproduction of maps, plats, reports, studies, and records related to land surveys.
