Provides relative to the penalties for certain domestic violence offenses that involve strangulation.
Present law (R.S.
14:34.9) provides for the crime of batteryof a dating partner.
Proposed law retains present law.
Present law provides that if the battery of a dating partner involves strangulation, the offender, in addition to any other penalties imposed pursuant to present law, shall be imprisoned at hard labor for not more than three years.
Proposed law amends present law to change the maximum penalty from three years to 10 years and provides that at least one year of the sentence imposed be served without the benefit of probation or suspension of sentence.
Otherwise retains present law.

14:35.3) provides for the crime of domestic abuse battery.
Proposed law retains present law.
Present law provides that if the domestic abuse batteryinvolves strangulation, the offender, in addition to any other penalties imposed pursuant to present law, shall be imprisoned at hard labor for not more than three years.
